VARIANCE REQUEST
The applicant requests relief from Section 10 . 4 of the Albemarle
County Zoning Ordinance to allow a subdivision of a 1 . 0 acre lot ,
a variance of 1 . 0 acre ; and also requests relief from Section 10 . 4
to allow 158 . 33 feet of road frontage , a variance of 91 . 67 feet .
Also requests relief from Section 10 . 4 to allow 217 . 54 feet of road
frontage on a second lot , a variance of 32 . 46 feet .
AREA CHARACTERISTICS
The Freeman property is located in rural area better known as the
Green Mountain area .
A number of single-family residences are within the immediate area
of the Freeman property. One residence is very close adjoining
the north property line .
The Freeman property houses a mobile home , garage , and a couple of
out buildings . Approximately one (1) acre of the 3 . 75 acre tract
is developed .
The existing residence is served by private well and septic system.
ZONING HISTORY
On March 13 , 1984, the Albemarle County Board of Zoning Appeals
denied variance #84-10 to allow the subdivision of a 1 . 0 acre
lot , a variance of 1 .0 acre , and to allow relief from Sec-
tion 10 . 4 to allow 158 . 33 feet of road frontage , a variance of
91 . 67 feet .
COMPREHENSIVE PLAN
The Urban Land Use Plan designates the area as Open Space , or a
minimum density of one dwelling unit per two (2) acres .

STAFF COMMENTS
The applicant is requesting relief from the minimum two (2) acre
density requirement , and a reduction from the road frontage pro-
visions .
As reported in the 1984 request , the applicant wishes to subdivide
the property and create a one (1) acre lot , with 158+ feet road
frontage ; and a residue lot of 2 . 75 acres with 217+ feet of road
frontage .
A strong attempt is made to discourage strip development along the
road frontage by design provisions of the ordinance .
Private water and sewer facilities necessitate the need for a
minimum area of two (2) acres per dwelling unit .
The applicant is requesting an area variance , but is essentially
the same as a rezoning or reduction of density requirement .
The staff is of the opinion that the intent as well as the provi-
sions of the ordinance are very straight forward , and there is no
evidence of hardship demonstrated . A variance of this sort would
be self imposing a hardship on the applicant ' s property to pro-
vide for any future septic/drainfield area .
STAFF RECOMMENDATION
Based on the aforementioned , the staff recommends denial .
