Goodwin TAX MAP/PARCEL: 46A/Section 4, Blk-C, Lot 6 ZONING: R-2 LOCATION: 503 Berwick Court VARIANCE REQUEST The applicant requests relief from Section 14 . 3 of the Albemarle County Zoning Ordinance to allow an attached carport to be located 2 . 5 feet from the side property line , a variance of 7 . 5 feet . AREA CHARACTERISTICS The Goodwin property is located in the Westmoreland subdivision . Lots abutting the Goodwin lot are a part of the Fieldbrook Sub- division . Located on the Goodwin lot are the single-family residence with a covered terrace area at the rear , and an asphalt driveway to serve access to the proposed carport . An existing brick retaining wall that spans from the street along the side property line is anticipated to be used for supportive means for the proposed car- port . In 1975 a portion of lot 7 , indicated as X on a plat of the same date , was added to lot 6 . The additional area was used to con- struct a retaining wall , to control stormwater , and drainage run- off . The topography of lot 7 is three (3)+ feet than the Goodwin property adjacent to the proposed carport addition. COMPREHENSIVE PLAN The Urban Land Use Plan designates the immediate area of Westmoreland and Fieldbrook subdivisions as low density residential . STAFF COMMENTS A single carport could be constructed along side the existing house and attached without the need for a variance request . The Goodwin ' s proposal is for the construction of a double car- port and would require the need for a variance from the required ten (10) foot setback . The fact that an addition could be added to the existing structure shows that adherence to the ordinance requirement would not be an undue hardship. Nme Page 2 Staff Report - VA-86-10 Emily P. Goodwin Other houses in the surrounding area appear to have the same approximate amount of setback , thus in most situations would have sufficient space for some type of room, porch, etc . addition. The intent of the ordinance provisions relating to setback is to prevent obstruction of light and air , overcrowding of the land , and to protect against fire and similar dangers pertaining to health and safety. STAFF RECOMMENDATION The staff must make a recommendation for denial based on the variance standards . Should the Board consider a favorable decision , the following condition is recommended : that the carport addition cannot be enclosed to make a habitable space .
