Chandler TAX MAP/PARCEL : 77E2/2 ACREAGE : 14 . 95 ZONING: LI (Light Industry) LOCATION: On the east side of Avon Street Extended (Rt . 742) , almost opposite the intersection of Rt . 1101 & Rt . 742 VARIANCE REQUEST The applicant requests relief from Section 26 . 10 . 1 of the Albemarle County Zoning Ordinance to allow a freestanding sign (#1) to be lo- cated 20 feet from St. Rt . 742 , a variance of 30 feet ; and 18 feet from private road right-of-way, a variance of 32 feet . And also to allow a freestanding sign (#2) to be located 20 feet from the public road right-of-way, a variance of 30 feet . AREA CHARACTERISTICS The applicant ' s development better known as Student Services Office and Warehouses is located on Avon Street Extended just south of the Corporate City Limits . Student Services development is shown to have two (2) phases . The first phase will have two (2) warehouse buildings with an accessory apartment fronting on Rt . 742 , and an office building located to the rear . The proposed sign would be located adjacent to the security fence at just beyond a twenty (20) foot setback . The warehouse buildings are located at the minimum fifty (50) foot setback . Any proposed signs would be required to also meet a fifty (50) foot setback . ZONING HISTORY The approved site plan for development indicates two (2) phases . COMPREHENSIVE PLAN The Urban Land Use Plan indicates Industrial Zoning for both the west and east sides of State Route 742 from the Corporate City Limits south to the crossing of Interstate 64 . Chandler) VARIANCE REPORT The Board of Zoning Appeals granted a variance from Section 26 . 10 . 1 of the Zoning Ordinance to allow a freestanding sign to be located thirty (30) feet from the public road right-of-way, a variance of 20 feet ; and , also to erect a second freestanding sign for Unogen to be located 15 feet from the public road right-of-way, a variance of 35 feet . STAFF COMMENTS The staff would like to address the variance for sign #2 , first . At present the sixty (60) foot road right-of-way is a private road , and the applicant was put on notice that the access road would be dedicated to the County whenever the county so requests . If the dedication has not been exercised by deed recording at this time , then a variance would not be required . An evaluation of the proposed variance is as follows : It appears northbound travel on State Route 742 would have visual notification by means of a sign located at the required fifty (50) foot setback . Traveling southbound on State Route 742 , you would be approaching the site on an uphill grade , having a limited visual access to any sign setback at the fifty (50) foot requirement . Along with a variance for setback the increased height of the sign would then appear to provide an adequate notification . The approved site plan indicates landscaping, and a security fence which would possibly obstruct the view of a sign at the required setback . The variance request has similar characteristics as was brought out in the report of the Astec variance . Physical conditions on the prepared site , as well as the Astec site prevent the applicant from locating a sign at the required setback to provide for adequate notification . In summary, the staff finds that this property shares similar physi- cal conditions as another , but on the other side of the issue it doesn' t unreasonably restrict the applicant from use of the property, and it would not be of a substantial detriment to any of the adja- cent properties if the variance were to be granted . (804) 20320ea2 97_3`8G L April 23, 1986 Zoning Administrator Zoning Department 4.01 McIntire Road Charlottesville, VA 22901-4596 RE: Application for Variance for Sign Location - MC Partnership 1501 and 1505 Avon Street Extended Dear Sir, Attached is the Application for Variance with drawings/sketches of the proposed signs and location of each with a check for the permit of $50. 00. This application is submitted in accordance with the Albemarle County Zoning Ordinance Section 34.0. It is requested that a variance be granted to the regulations applicable to the location of two business signs for the above referenced project. The enforcement of the provisions of this ordinance would result in a hardship for the applicant. Spe- cifically, it is requested that sign #1 be located at the fence line approximately 22 feet from the property line on Avon Street, requiring a variance of less than 30 feet (see figure #1 ) . For sign #2, its location would be approximately 23 feet from the property line on the access road, again requiring a variance of less than 30 feet. The existing conditions/supporting data for this request are as follows: The set-back of 50 feet would a. place the location of each sign in a paved area and be an obstruction to the traffic flow within the property. b. because of the nature of the topography of the area limit the visibility of the sign from Avon. c. further hinder the visibility created by the ex- cavation requirements resulting from the poor soil conditions. d. also affect the visibility because of the planned landscaping This variance would not create a precedent since other bus- iness signs along Avon Street are within the 50 foot set-back. The area from Moores Creek to I-64 on both sides of Avon Street Extended are zoned for industrial use. As agents for the owner, we respectfully request that this variance be approved.
