Huckle Gentlemen Next Tuesday, July 8th, the Board of Zoning Appeals will be asked by Belveder Land Trust and the Marriott Corporation to consider two appeals for help. Both requests are necessary, in our judgement, because of the geographic location of the proposed Marriott Motel in the Branchlands P.U.D. The purpose of this letter and accompaning sketch is to assist you in visualizing the problem we are trying to minimize. The problem of visibility. On the sketch we have located the old road to the church (in green) that will be abandoned. The new road from Rt. 29 and the road connecting Greenbriar Drive and Squire Hill Apartments is also shown (in blue) . So that you may have a good feel for this we have located on the ground 5 flags with red surveyors tape. Flag #1 -- This marks the s/w corner of the building. Flag #1A -- This is 6 ' off the church road and will assist in locating Flag #1 . Flag #2 -- This marks the s/e corner of the building. Flag #2A -- This is 6 ' off the church road and will assist in locating Flag #2. Flag #3 -- This is located in the VDH & T r/w at the point where the new road will be located to match up with the existing medium cut. County Office Building Charlottesville, VA 22901 Re: Va. 86-12 Gentlemen: It has been suggested that Belvedere Land Trust assist in an effort to control future proliferation of "Directional Signs" at the new proposed entrance to the Branchlands P.U.D. Belvedere Land Trust will agree to not grant any further sign easements along Rt. 29 unless they have been approved by the Planning Commission and/or the Board of Zoning Appeals . Hurt w STAFF REPORT - VA-86-12 APPLICANT: Belvedere Land Trust TAX MAP/PARCEL: 61Z/03-1 (part of) ACREAGE: 40.96 acres total ZONING: PUD (Planned Unit Development ) LOCATION: East side of Route 29, .6 mile south of intersection of Route 29 and Route 631 The applicant seeks a variance from Section 3 .0 of the Albemarle County Zoning Ordinance. This section, pertaining to directional signs, states: "3 .0 Definitions Sign, Directional: A sign, one end of which is pointed on which an arrow is painted or otherwise indicates the direction to which attention is called, not illuminated, four (4) square feet or less in area, giving the name only of a person (s) , farm, business or other establishment . " The applicant , acting in the interest of Marriott Corporation, proposes to place a directional sign at the northeast corner of Route 29 and the to be constructed access road. This request was deferred from the June 10, 1986, Board of Zoning Appeals meeting. The applicant has submitted a conceptual drawing showing a singular sign structure which could be used by a minimum of four (4) busi- nesses or establishments for directional purposes. The submitted drawing indicates that the total height of the sign would be twenty-four (24) feet and contain a signage area of not more than one hundred (100) square feet . The applicant has indicated that no other directional signs will be requested at this intersection at this or any future date. At the previous public hearing, Rev. Michael D. McCarron of The Church of the Incarnation and Mr. Ronald Langman of Branchlands Corporation submitted letters of opposition to the directional sign request . However, Mr. Langman has notified the Zoning Department by letter that he supports " a single-entrance sign for the entire area. " Rev. Michael D. McCarron has not contacted this office since the previous public hearing. The staff recognizes the need for a directional sign for Marriott Corporation due to the fact there is no direct access to the property from Route 29. My earlier objections still stand , however , if Dr. Hurt et al would develop a single entrance sign for the entire area that would be better and I would then be in favor. As we discussed , I am concerned that we would have alot of signs and what fashion square did is more favorable. On another matter , has John Horne talked to you about Daly 's Rent-All? I am very concerned about this site since it is very messy, as well as, hazardous due to all the trucks parked there. Last year a site plan for a nursery on the adjacent site was proposed and turned down due to appearances . Now, however, there are trucks parked all over that site making it look even worse. " The applicant , acting in the interest of Marriott Corporation, proposes to construct two (2) directional signs and one (1) free- standing business sign . One (1) directional sign , having a sign area of approximately twenty-five (25) square feet will be located at the northeast corner of Rt . 29 and the to be developed access road . The second directional sign , having a sign area of approxi- mately twenty-one (21) square feet will be located on the east side of the development site . The free-standing business sign has a sign area of approximately eighty-five (85) square feet and an overall height of twenty-five (25) feet . This sign is to be located on the west side of the development site . The applicant seeks a variance of the directional sign size limitation from the maximum allowable area of four (4) square feet to twenty-five (25) and twenty-one (21) square feet . In addition, the applicant requests that he be allowed to erect a free-standing business sign in a PUD. The Zoning Ordinance does not allow for this type sign in a PUD District . The Zoning Ordinance stipulates that business signs in a PUD District are to be wall signs only. The applicant previously applied for and received a variance from the Board of Zoning Appeals (VA-86-06 , granted April 6 , 1986) enabling a reduction of the number of parking spaces to be provided . The variance was granted with the condition that there be no separate signage legible from off the site advertising the restaurant , bar, or meeting room facilities . Other zoning information regarding this development site includes : Page 2 .r Staff Report - VA-86-12 Belvedere Land Trust , Etal . a) approval of Branchlands PUD by the Board of Supervisors on September 10 , 1975 , and b) approval of a Special Permit by the Board of Supervisors on December 4 , 1985 , enabling the development of a motel/ hotel or inn. In the matter presently before the Board of Zoning Appeals , the applicant cites both the location of the development as well as area topographical conditions as the causing factors for the variance requests . Due to the location of the development off of Rt . 29 , the staff recognizes the need for a directional sign to be located at the intersection of the access road and Rt . 29 . However , the size of the directional sign does cause some concern, particularly in view of the applicant ' s request for a free-standing business sign as well . The application as presented , should be denied . The free-standing business sign cannot be approved as there is no provision for this type sign in a PUD District . The Board of Zoning Appeals may desire to approve the directional sign requests subject to a reduction in size and compliance with appli- cable setback requirements of the Zoning Ordinance . In making a determination on the directional signs , the Board of Zoning Appeals should be cognizant of the precedent which will be established for the Branchlands PUD development as well as other PUD and PRD (Planned Residential Development) properties . RECOMMENDATION The application, as presented , should be denied for cause : 1) The applicant has indicated that site location and area topographical features have created a hardship . The staff agrees but is concerned first with the size of the proposed directional signs and second with the fact that a free- standing business sign is not permitted in a PUD District . 2) The applicant ' s hardship is shared by other properties in the general vicinity. Future developments in the Branch- lands PUD will experience the same business identification problem. 3) The approval of the variance request as submitted will be of substantial detriment to the area due to the precedent which would be established both in regards to the size of directional signs and in allowing a free-standing business sign in a PUD District . ; Lt New Nee TRANCHLAND CORPORATION June 6 , 1986 Charles W. A precedent would be set by granting this easement to one developer of the land; also the lack of aesthetics along Rt. 29 as it would affect our parish property and buildings. Our parish buildings were designed specifically with the intent of keeping the visual images within our boundaries soft and forest-like, and this variance would greatly diminish and violate this intent for us. Also, Rt. 29 North is already visually congested with a multitude of different sign images which make it a dangerous distraction. As a community of 650 families , we ask that this not be abridged. The application is actually being made on behalf of Marriott Corporation, the contract purchaser. Also enclosed is our check payable to the County for $50 . 00 to cover the application fee. Because of the location of the motel site well back from Route 29 , as well as the two turns required in order to reach the motel site, it will be a hardship, in fact probably economically not feasible, for Marriott to operate the motel without the proposed signs. As can be seen from the exhibits, the signs are not garish, but are simply functional and in good taste. We will be happy to meet with you at your convenience to discuss this matter.
