Hi Michele,
The next step, in terms of ARB review, is to apply for a Final Site Plan Review. The ARB application and checklist are
provided in the hyperlinks. Ideally, this should be submitted to the ARB at the same time you submit the Final Site Plan
or the MajorAmendment to the Site Review Committee (SRC), although it can be done in advance of that submission as
well. At the end of the ARB Final SDP review process, the project will be issued a Certificate of Appropriateness and ARB
staff can approve the Final Site Plan for the SRC. Note that a Final Site Plan or Maior Amendment cannot be approved
until a Certificate of Appropriateness is granted.
You do not need to submit an application for the ARB category of Building Permit Review.
When your Final Site Plan (submitted to the SRC, not the one submitted to the ARB) is approved by all intra- and inter-
agency reviewers, then you may apply for your building permit.

Margaret: Due to the multiple times the staff and the ARB have devoted time and attention to the LongHorn, I need to
know if we can submit an application and fee for the building review now concurrently with the Initial Site Plan Review
and Special Exception packages. Since the exterior design for the frontage with the Rt 29 Entrance Corridor view has
been controversial, we would like to acquire exterior building design approval early if possible.
We clearly understand there will be no building construction drawing submission for a building permit any time soon,
but would greatly appreciate concluding the exterior design review.

Do you require the Concept Plan/Advisory Review Submittal Checklist again with eight (8) folded prints of everything?
Yes.

It was good to attend the ARB work session meeting to see the latest ideas for the proposal. After the ARB
meeting I brought your idea back and discussed it with our master plan folks.
We liked the pedestrian connection being proposed in place of the stairway accessing Rte. 29; however, the
connection alone still won't be enough to function or meet the intent of the 10' shared use path for bikes and
pedestrians throughout the site, which is recommended in the adopted master plan. Your current proposal only
brings pedestrians from Rte. 29 into the site but doesn't allow them to access the site from the south of the site.
Staff s suggestions for sidewalk improvements as noted in the 12-4-18 email to Michele are still applicable.
However, you could propose other ideas to meet that same intent and function. Feel free to email me any ideas
you have and I'll provide you some initial guidance on each individual solution before you submit it in the site
plan.

Hi Scott,
Of course, no problem. Since getting off of the telephone with you, I have looked at my emails and notes regarding
Longhorn and I believe I remember the project history from the ARB perspective to date. An Initial Site Plan (ARB-2018-
123) was approved with recommendations for the Final Site Plan in October 2018 (see attached letter). In November,
the applicants submitted a revised site plan to SRC which addressed the pedestrian connectivity that the lead planner
et.al. had requested; because this revision constituted a significant change in the site layout from what the ARB had
approved the previous month, the applicants chose to submit a second Initial Site Plan (ARB-2018-153) for ARB review.
This second application was incomplete, and the proposed design for the pedestrian connection (ramps and stairs on the
Rt. 29 frontage) caused ARB staff some concern. Ultimately, the applicant chose to defer this ARB application on
12/11/2018 (see attached email).
I encourage you to contact Chris Perez, the lead planner, to discuss the Special Exception that he was handling and the
connectivity requests the SRC made. After discussing your request for a work session with Margaret just now, I also want
to convey that we hope the applicant is prepared to address the site layout issues as well when he comes to the ARB;
basically, we can discuss the building design, but not in a vacuum. Where the building is situated on the site and how it is
oriented to the street and the resolution of the pedestrian connection will ultimately inform the design of the building.
That said, the agenda for March 18 is open and we hope that if you all come that we can have a fruitful work session on
the design of the building as well as the outstanding site layout issues.

I'm following up on Chris' email (below) from December 41h to inquire whether you and
your client wish to move ahead with the ARB submission we received November 26th
and that is docketed for the January 7th, 2019 ARB meeting. I just want to be clear that
there are two options for moving ahead with your ARB application as it stands:
1. 1 review the materials you have submitted as a Concept Plan/Advisory Review.
The ARB then makes its recommendation to the Site Agent (i.e., Chris) in regards
to the Special Exception you are requesting.
2. You defer this ARB application until all materials are received for a complete
review, either as a Concept Plan/Advisory Review or as Preliminary Site Plan
review.
If you choose the first option, I want to be clear that staff has reservations about the
configuration of the ramp proposed for the Entrance Corridor, Route 29. Without having
undertaken a full review of the proposal as yet, I cannot say definitively whether we will
support this feature in our staff report to the ARB.
If you choose to defer, I need an email response from you saying as much. Regardless of
which option you choose, I would like a response indicating your decision by tomorrow
at close of business in order for me to provide a staff report for the January 7th ARB
date. If I do not hear from you by tomorrow, I may not have your staff report done in
time for the meeting on January 7th (due to the holiday schedule) and your item will be
rescheduled for the next meeting.
Please let me know at your earliest convenience how you wish to move forward.

As discussed the initial site plan is still deferred and shall be fully revised and
reviewed prior to initial site plan approval. The most recent submittal was a
revision of the variation/SE request and the plan provided is to be used as a
concept plan for ARB and BOS consideration.
Heather has provided the following guidance: "After some consideration,
Margaret and I believe we can take the present application to the ARB as a
Concept Plan/Advisory Review [for a Special Exception Request] on January 7.
However, the submission still fails to meet the checklist for a Concept
Plan/Advisory Review in one regard: the site plan you submitted is missing
"Existing and proposed topography and conceptual grading drawn with contour
intervals of 5-feet or less, and with sufficient offsite topography to describe
prominent and pertinent off -site features and physical characteristics, but in no
case less than 50-feet outside of the site," noted in section B.B. If you can provide
me this information before December 10 at the latest, and preferably by this
Friday, December 7, my staff report and review will be complete; if not, then my
staff report will mention this lack of data. It may mean that my staff report
recommends that the applicant revises the application to provide this information
for a subsequent review, or the ARB may ask for such information at the meeting.
I just want to make you aware of that.
One more thing: although Margaret, Chris, and I have not undertaken a full
review of this submission, we are aware of the ramp feature that is proposed for
Rt. 29, to provide bicycle and pedestrian access directly to the site from the right-
of-way. While we believe this connection is important, we believe this design
solution is not appropriate for the Entrance Corridor and we will not recommend
approval of the site plan to the ARB given the magnitude of this feature on the
Entrance Corridor. We encourage you to find alternate design solutions that
would require less pavement and railing. Please let me know if you have further
questions."
I would like to use this opportunity to discuss the proposed pedestrian and bike
connection. Whereas you have provided a compact 10' shared multi use path from
the sidewalk along the frontage to the site, and moved a long way towards
meeting the suggestions of staff, we think some improvements will improve what
you are providing and more likely to receive endorsement from the pertinent
boards and commissions. After an initial review staff does not feel this design
forwards the intent of the 10' shared multi use path because it is not convenient
for cyclists to use. The short switchbacks require riders to get off their bikes and
walk up the hill. Staff thinks that there is a better, more usable design that would
make it more convenient for all users. Additionally, I have a feeling this design
will not be aesthetically pleasing to the ARB upon their review of the profile due
to the large concentration of pavement and railings fronting the EC (as discussed
above). To these ends, I offer the following suggested change:
Provide a 6' wide sidewalk along the access road south of the site, provide a
sidewalk min 5' bordering the parking (I'd prefer 6'), and replace the proposed
30' ramp with a 5' wide staircase accessing the frontage (see below).

I am returned today from family medical leave, and can answer your last question:
The ARB's recommendation to the site agent made at the October 15, 2018 meeting included 28 recommended changes
for the final site plan; no request or requirement was made to see a revised initial site plan, and as one of several
reviewers of the SDP2018-66, ARB staff made no objection to the initial site plan as it stands. So, in short: no, you do not
have to bring a revised initial site plan back to the ARB prior to approval unless you are contemplating drastic site
layout changes that would greatly affect what the ARB has already seen. If you want to tell me what changes you have
in mind, I can better make that call.
When you submit a revised initial site plan to Chris, he will, as he wrote in his response, then route copies to various SRC
reviewers. I will be one of those reviewers asked to comment. It may behoove the process if you address at least some if
not all of the ARB's 28 recommended changes for the final site plan that are listed in the attached action letter, although
— again — these are not required until the final site plan is submitted.
I hope this has clarified this one question; again, contact me if you believe the changes you are contemplating are
potentially significant enough to warrant a second ARB review of the initial site plan, which at this point, is not
necessary.

Chris: After much contemplation, it has been decided the LongHorn plans will be revised and resubmitted rather than
taking the current plans to the Planning Commission and the Board of Supervisors. Therefore, we request a hold for the
site plan review for permitting. I assume your request for "a hold" is truly a request for a "deferral". If so please clarify.
Please confirm, as soon as we revise and resubmit the staff will review for recommending action on the special
exception application. Once the revised plans are submitted they will be distributed to appropriate SRC reviewers for a
review to ensure there is no additional issues. Once this hurdle has been cleared staff will write the staff report for the
special exception.
Is there a deadline for submission in order to be placed on a particular agenda? It really depends on when you resubmit
and if the revisions adequately address the issue. If they do, this moves quickly and can be placed on a BOS consent
agenda. If they do not, we look to the PC schedule.
Are we required to go back to the ARB with the revised site plan before we can progress with the special exception
meetings? I believe Margaret would need more information to respond to this, specifically what your revision consists of
— where specifically the building is being relocated to. She is currently on vacation and shall return on the 291h. Heather
is currently out of the office on family emergency leave. So at this point I have no one from ARB staff available to
respond to this question. My guess is it depends on what is changing.
