This section, pertaining to Area and Bulk Regulations in a RA District , states: "10. 4 Area and Bulk Regulations Yards, minimum: Front 75 feet . . . " The applicant has recently constructed a new single-family dwelling (Building Permit , BP-86-155, issued February 24, 1986) . Upon doing the final survey, it was detected that the front most corner of the dwelling is located sixty-five (65) feet from the front property line. The applicant requests a variance of the front setback from the minimum requirement of seventy-five (75) feet to sixty-five (65) feet . The builder of the dwelling has indicated in an attached letter that the physical edge of the roadway was mistaken for the front property line when the dwelling was staked. In actuality the right-of-way extends ten (10) feet from the physi- cal edge of the roadway. Subsequent inspections by the Zoning Department staff during construction did not detect the violation. The error was found when the surveyor was preparing the final survey. Recommendation: Due to the positioning of the dwelling and the fact the property is located on a cul-de-sac, it appears that the authorization of this variance would not negatively impact the adjacent properties, nor would the character of the district be compromised. The staff recommends approval of the applicant ' s request. However, the builder should be admonished to make a better effort to ascertain all property lines in future con- struction projects, as this department may not be as considerate in the future. vA -S'6" - ,1.5 \si , , !rr-- -. It was our belief at that time that the front property line was the street. The error was brought to our attention by our surveyors when on the site for FINAL Survey - copy attached hereto.
