Section 4. 15.3 .6 - Business Signs, Freestanding or Projecting: . . . (B) the aggregate area of such signs shall not exceed fifty (50) square feet . Section 21.7. 1 - Minimum Yard Requirements - Commercial Districts Generally, Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. The applicant proposes to erect a freestanding business sign sixty (60) square feet in aggregate area to be located seven (7) feet from the road right-of-way. The applicant is seeking a variance of ten (10) square feet above the allowable fifty (50) square feet, and also a setback variance of twenty-three (23) feet from the required thirty (30) feet . A site plan has been approved for the development of the site, and at the present time is about 80% complete. The proposed sign shows two (2) vacant panels which indicate signage for other tenants. RECOMMENDATION The variance, as submitted, should be denied on the basis: 1) The applicant has not demonstrated that a strict application of the Ordinance would produce a hardship as distinguished from a special privilege or convenience. As indicates on the site, there are locations on the site a freestanding sign could be placed to meet the required setback of thirty (30) feet . Another two (2) alternatives would be a wall or roof sign.
