Nunley TAX MAP/PARCEL: 45/68C(1) ACREAGE: 3.63 acres ZONING: HC (Highway Commercial ) LOCATION: Northwest of Rt . 29, + .6 mile north of the intersection of Rt . 29 and Rt . 643 The applicant seeks a variance from Section 21. 7. 2 of the Albemarle County Zoning Ordinance. This section, pertaining to commercial setback requirements, states: "21. 7 Minimum Yard Requirements 21. 7. 2 Adjacent to residential and rural areas districts: No portion of any structure except signs advertising sale or rental of the property shall be located closer than fifty (50) feet to any residential or rural areas district . No off-street parking or loading space shall be located closer than twenty (20) feet to any residential or rural areas district . " The applicant desires to construct a commercial addition and seeks a variance of the required setback from the adjacent resi- dential properties from the minimum requirement of fifty (50) feet to thirty-seven (37) feet . The adjacent properties (to the north- west ) are zoned R-15. The proposed addition will provide addi- tional warehouse area for Better Living, Incorporated. The applicant did not submit information showing the dimen- sions of the proposed addition. It is therefore difficult for the staff to determine if there are any viable alternatives as to location of the proposed structure or if the applicant is simply overcrowding the property. RECOMMENDATION - The application should be denied for cause: 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordi- nance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. In viewing the applicant ' s plat it appears that the configuration of the property may cause some degree of hardship. A determination of hardship can be made once the applicant provides the staff with a more definitive idea as to the dimensions of the addition. 2) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and the general vicinity.
