Roth Roth Theatres TAX MAP/PARCEL: 61W/03-9 ZONING: C-i ACREAGE: 57,403 square feet LOCATION: Located on Greebrier Drive The applicant requests a variance from Section 21 . 7. 1 of the Albemarle County Zoning Ordinance. Section 21. 7.1 of Commercial Districts - generally states: "21. 7.1 Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way. " A request is made to construct an addition to the Greenbrier Theatres and locate it within twenty-two (22) feet of an access easement , seeking a variance of eight (8) feet . To accommodate the new addition some existing on-site parking will be eliminated but will be relocated on the adjoining lot . The lot west of the access easement will provide the required parking for the additional seating capacity, including the eliminated spaces taken by the proposed construction. RECOMMENDATION The application should be denied for cause: 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. Expansion of the existing structure is feasible but not in the volume as applied for without the benefit of a variance. Development of the adjacent lot is a possibility, but it may not be the most practical . 2) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. Other properties in the Commercial zones share similar situations where easements are involved with the setback of the main structures. APPLICATION FOR ZONING VARIANCE November 18, 1986 GREENBRIER THEATRES / 375 GREENBRIER DRIVE / CHARLOTTESVILLE, VIRGINIA Variance Sought Our two parcels are separated by a 60 ' Access Easement for State Road 866 , which runs west-south-west from Greenbrier Drive to the entrance gate of Comdial Telephone Systems , Inc. We have in place a retaining wall which runs parallel to the Access Easement, along the east side of same . The retaining wall is approxi- mately 14' from the Access Easement and 53' from the existing west wall of the Greenbrier Theatres. We propose to erect an addition to the Greenbrier Theatres which will run from the existing west wall of the theatres to within approxi- mately 10 ' of the retaining wall , with an exit-sidewalk occupying most of the remaining space between the addition and the retaining wall . We request a variance of approximately 8' in the required 30' set- back from the Access Easement, in order to locate the addition. The proposed addition would then be approximately 22' from the Access Ease- ment , but still east of the existing retaining wall. The applicant must re-design building or request an 8 ' variance. VA f6_46 (2) A 10 ' parking setback line must be maintained. (3 ) The proposed parking area should be lighted. (4) The handicap spaces and ramp should be relocated to the side. Handicap spaces should be 8 ' with an adjacent 5 ' aisle. (5) Need to know number of existing seating in the theatre to determine adequate parking. (6) Engineering should look at the retaining wall at rear of site. (7) Parking lot specs on paving, etc. should be submitted. (8) Any signs to be installed or relocated should be shown . (9 ) Is any additional right-of-way to be dedicated to Greenbrier Dr . ? (10) Mark front of building as no parking.
