LOCATION: 1907 East Market Street
The applicant seeks a variance from Section 4.11. 2. 1 of the
Albemarle County Zoning Ordinance. This section, pertaining to
accessory structure setbacks, states:
"4.11.2. 1 ACCESSORY STRUCTURES
If no utility or drainage easements or other easements
are adversely affected, accessory structures or portions
thereof may be erected no closer than six (6) feet to
adjacent lot lines in the case of detached structures,
or to a common wall in the case of attached structures;
provided further that no such structure shall be located
within any yard required by section 4.6.3 . "
The applicant proposes to construct a twelve (12 ) foot by
twelve (12) foot accessory structure on the east side of his dwell-
ing and seeks a reduction of the side yard setback from the minimum
requirement of fifteen (15) feet to two (2) feet . The proposed
structure will be utilized as a storage shed. The applicant states
that he does not want to place the structure on the north side of
an access easement which dissects his property. Consequently, the
applicant cannot construct the structure without benefit of a
variance. The two (2) properties to the east of the applicant also
are dissected by the access easement . Accessory structures for
both of these properties are located on the north side of the
access easement .
RECOMMENDATION
The application should be denied for cause:
1) the applicant has not provided sufficient evidence
to show that a strict application of the Zoning
Ordinance would produce a clearly demonstrable
hardship approaching confiscation, as distinguished
from a special privilege or convenience
2) the applicant has not demonstrated that his
perceived hardship is unique to his property in
contradistinction to other properties in the
same zoning district and the general vicinity.
The requirement the applicant seeks relief
from is shared by all residential properties

3) the applicant has not provided evidence to demonstrate
that the authorization of this variance will not be of
substantial detriment to the adjacent property on that
the character of the district will not be altered.
