APPLICANT: Bobby D. Martin, Sr.
TAX MAP/PARCEL: 59/16A
ZONE: RA (Rural Areas)
ACREAGE: 6.62 acres
LOCATION: South side of Route 250, ± .2 mile east of the
intersection of Route 250 and Route 677
The applicant seeks a variance from Section 4.6. 3 .2 of the
Albemarle County Zoning Ordinance. This section states:
"Other yards adjacent to streets shall have a minimum
width on depth, as the case may be, of eighty (80)
percent of the minimum front yard depth required in
the district in which the lot is located. This pro-
vision shall apply to lots in the RA or residential
districts only. "
The applicant is in the process of subdividing his property
and in so doing is transforming an existing private drive into
an ingress-egress easement to serve the new parcel. The applicant
seeks a variance to reduce the setback from the access easement
to his existing dwelling from the minimum requirement of sixty
(60) feet to thirty (30) feet . In viewing the applicant ' s
property, it appears that the only "hardship" involved in relo-
cating the access easement is financial (i .e. the cost of clearing,
grading, etc. ) .
RECOMMENDATION
The application should be denied for cause:
1) the applicant has not provided sufficient evidence
to show that a strict application of the Zoning
Ordinance would produce a clearly demonstrable
hardship approaching confiscation as distinguished
from a special privilege or convenience
2) the applicant has not demonstrated that his perceived
hardship is unique to his property in contradistinc-
tion to other properties in the same zoning district
and the general vicinity. The requirement the ap-
plicant seeks relief from is shared uniformly by
all residential properties
The authorization of the variance request would not be
detrimental to the adjacent properties nor would the character of
the district be altered.

(Reference your memo dated 9/16/85)
As we discussed earlier this week , I think it is appro-
priate in this case to assign a development right (one each)
to the hotel structure , the cinderblock residence , and the
mobile home . This means that further residential development
on the 6 . 62 acre parcel could not occur . I believe it would
be appropriate for the property owner to replace the mobile
home with a single-family dwelling if he so desired .
It is my understanding that the subdivision issue will be
handled by you. This office will process Mr. Martin ' s request
for metering on the hotel structure .
