If so, state substance of decision: 4 Date of Hearing: 19 Final Decision Made: The variance sought e •. r„3ith the followingconditions:�h ailP 1C ti 3 OLA) gLUJO Ltbd Special Use Permit# BOARD OF ONING APPEALS Sign Permit# BY: r 7 .' to Building Permit# 3 moo STAFF REPORT - VA-86-23 APPLICANT: Belvedere Land Trust TAX MAP/PARCEL: 61Z/03-1 (part of) ACREAGE: 40.96 acres ZONING: PUD (Planned Unit Development ) LOCATION: East side of Route 29, .6 mile south of intersection of Route 29 and Route 631 The applicant seeks a variance from Section 4.15.3.5 of the Albemarle County Zoning Ordinance. This section, pertaining to permitted signs, states: "4. 15.3.5 Residential (R-10 and R-15) ; Planned Residential Development (PRD) and Planned Unit Development (PUD) . Business Signs: Limited to wall signs with an aggregate area not to exceed twenty (20) square feet . . . " The applicant , acting in the interest of Marriott Corporation, seeks a variance to increase the size of a proposed wall sign from the maximum allowable area of twenty (20) feet to eighty-five (85) feet . The proposed sign would be internally illuminated and would be located on the southwest portion of the structure. This loca- tion will cause the sign to be viewed by motorists traveling north on Route 29. The applicant ' s basis for the variance request is the distance that the development is located from Route 29, thereby causing a twenty (20) square foot sign to be inadequate. The applicant appeared before the Board of Zoning Appeals on June 10, 1986 (VA-86-12) requesing that an eighty-five (85) square foot freestanding business sign be permitted. The Board denied the request on the basis that freestanding business signs are not permitted in a PUD (Planned Unit Development) . RECOMMENDATION The application should be approved for cause: 1) the applicant ' s "hardship" is the location of the development in relationship to Route 29. A twenty square foot wall sign is not of sufficient size to be legible to motorists on Route 29 2) it cannot be determined if the applicant ' s hardship will be shared by other properties in the general vicinity at this time . Whether or not the hardship will be shared, will be dependent upon the type of development which occurs in the future.
