Final Decision Made: The variance sought w c�eni •prow_ with the following conditions: NO a Special Use Permit# BOARD OF G AP Sign Permit# ate Building Permit# Noe ,401, STAFF REPORT - VA-86-24 APPLICANT: Grove Construction Company TAX MAP/PARCEL: 42/153 ZONE: RA (Rural Areas) ACREAGE: 2. 25 acres LOCATION: in Whipporwill Hollow Subdivision (Lot 71) on Thrush Road The applicant seeks a variance from Section 10. 4 of the Albemarle County Zoning Ordinance. This section, pertaining to the RA District , states: "10. 4 Area and Bulk Regulations . . . Yards , minimum Front - 75 feet . . . " The applicant is in the process of constructing a new single- family dwelling and seeks a reduction of the front setback from the minimum requirement of seventy-five (75) feet to sixty-seven (67) feet . The causing factor behind the applicant ' s request is that a member of the Zoning Department staff made an error in estab- lishing the front setback line. The applicant had requested that the Zoning Department make a determination as to the front setback line prior to the footings being dug. The error was not discovered until after the footing and foundation work were complete. The Zoning Department accepts responsibility for this error and re- quests that the applicant be afforded some consideration in this matter. The problem has been compounded by the fact that the applicant continued to work on the structure until a stop work order was posted on the construction site on June 27, 1986. RECOMMENDATION The application should be approved. The applicant acted in good faith and depended upon the expertise of the Zoning Department staff to establish a front setback line which would be in compliance with the Zoning Ordinance requirement . Unfortunately, through no fault of the applicant , an error was made.
