LOCATION: North side of Route 250 at its intersection
with Folly Road
The applicant seeks a variance from Section 26.6 of the
Albemarle County Zoning Ordinance . This section, pertaining to
height regulations in an industrial zone, states:
"26.6 Height Regulations
Structures may be erected to a height of sixty-five
(65) feet ; provided that any structure exceeding
thirty-five (35) feet in height shall be setback
from any street right-of-way, or residential , or
agricultural district ; in addition to minimum
yard requirements, a distance of not less than
two (2) feet for each one (1) foot of height in
excess of thirty-five (35) feet . . . "
The applicant applied for and received a variance (VA-81-46)
on August 11 , 1981, which allowed the reduction of the front setback
from the minimum requirement of one hundred fifty (150) feet to
seventy-six (76) feet . The one hundred fifty (150) front setback
is required by the Zoning Ordinance as the property is located in
a Scenic Highway Overlay District . This previous variance was
granted with the condition that the exterior of the structure
which is visible from Route 250 be constructed of brick embossed
block. There have been five (5) additional variances applied for
pertaining to this property since 1977. None of these requests
contain information pertinent to the matter presently before the
Board of Zoning Appeals.
The applicant desires to construct a new office building
having a height of forty-one (41) feet and seeks a reduction of
the required front setback from eighty-eight (88 ) feet to seventy-
six (76) feet . In view of the previous consideration the appli-
cant has received from the Board of Zoning Appeals, the staff
recommends that the applicant ' s request be approved. In approving
the request , the Board may desire to make such approval conditional
on the building being constructed in general likeness to the archi-
tectural renderings presented by the applicant in regards to design
and exterior materials.

Please be advised that the Zoning Department has reviewed the
above referenced site plan and our comments are as follows :
(1) Although the Planning Commission may reduce the
' setback on a scenic highway (Section 30 . 5. 6 . 3 .1) ,
this does not relieve them from Section 26 . 6 ,
• (height regulations) .
This has been discussed with Mr. Roudabush. Either
the structure must be setback an additional amount
in accordance with Section 26 . 6 or a variance from
the Board of Zoning Appeals may be sought.
(2) Any signs should be indicated. All signs must comply

Luxury office complex set for Albemarle

Kessler said the building will be
leased for $14 a square foot, which
will include utilities and services.
The price is one of the highest in
Charlottesville.
