(Riverbend Ltd. Partnership) TAX MAP/PARCEL: 78/17G ZONING: PD-SC (Planned Development Shopping Center) ACREAGE: 5.259 acres LOCATION: Pantops Shopping Center, on south side of Route 250 East The applicant requests relief from Section 4. 15. 3 .7 of the Albemarle County Zoning Ordinance. This section pertaining to permitted signs in the Planned Development Shopping Center dis- trict states: "4.15.3.7 Highway Commercial (HC) ; Planned Development-Shopping Center (PD-SC) ; and Planned Development-Mixed Commercial (PD-MC) Business Sign, Wall : Provided . . . (b) the aggregate area of all such signs shall not exceed two (200) hundred square feet . " The applicant seeks a variance to increase the wall signage to 213 square feet from the 200 square feet allowable. The sign would be comprised of individual letters mounted to the wall of the building. The sign has been manufactured and already mounted onto the building. RECOMMENDATION The application should be denied for cause: 1 ) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The same requirement is shared by all other properties zoned PD-SC. 2) Sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special priviledge or convenience has not been provided. 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the charac- ter of the district will not be altered.
