The applicant requests a variance from Sections 4. 15. 3 .7
and 21.7.1 of the Albemarle County Zoning Ordinance. These
sections pertaining to permitted signs in the Highway Commer-
cial (HC) zone and minimum yard requirements in the Commercial
Districts state:
"4.15. 3.7 Highway Commercial (HC)
Business Signs, Freestanding or Projecting:
Provided: . . . (d) no more than two (2) free-
standing signs on any one (1) lot or premises.
Business Sign, Wall : Provided: . . . (b) the
aggregate area of all such signs shall not
exceed two hundred (200) square feet . "
"21.7.1 Adjacent to Public Streets: No
portion of any structure except signs
advertising sale or rental of the property
shall be erected closer than thirty (30)
feet to any public street right-of-way. "
The applicant proposes to erect a total of three (3) free-
standing signs consisting of two (2) identification and one (1)
business that amount to ninety-six (96) square feet (correction
on identification sign should be 2' x 14 ' instead of 2 ' x 13 ' ) .
A variance is requested to allow three (3) freestanding signs
rather than the two (2) allowed. A second part of this variance
is for the setback from Greenbrier Drive road right-of-way to be
eighteen feet in lieu of the thirty (30) foot required for the
free-standing signs. The applicant is requesting relief in order
to mount a total of six hundred and fifty (650) square feet of
wall signage rather than the two hundred feet allowed.
In a support letter the applicant states that due to the
nature of the development with its potential of having twenty-one
(21) tenants occupying the 40,000 square feet of space as reason
for the variance request . Physical characteristics of the prop-
erty are given as the need for the setback request .
The staff notes that the parking schedule submitted along
with the site plan limits the occupancy of the building space in
regard to retail space. Parking provided for the office use is
8,000 square feet net area and coupled with the limited retail
would certainly diminish the need for such a quality of wall
signage.

If the development were to be submitted as a condominium
regime then the two (2 ) identification signs could qualify under
subdivision signs and would not necessitate the need for a set-
back variance.
RECOMMENDATION
The application should be denied for cause:
1) The applicant has not demonstrated that his
perceived hardship is unique to his property
in contradistinction to other properties in
the same zoning district and general vicinity.
The same requirement is shared by all properties
zoned HC (Highway Commercial ) .
2) The applicant has not provided sufficient
evidence to showthat a strict application
of the Zoning Ordinance would produce a
clearly demonstrable hardship approaching
confiscation as distinguished from a special
privilege or convenience.
3) The approval of the variance (Area Request )
as submitted will be of substantial detriment
to the area based on the precedent which would
be established in allowing such an amount of
wall signage.

Re: Greenbrier Square
Dear Sirs :
This letter is written on behalf of Greenbrier Square Limited
Partnership in support of its application for a variance for the
signage at the Greenbrier Square development on Greenbrier Drive.
Greenbrier Square is a mixed use commercial development con-
sisting of 3 buildings totalling 40 , 000 sq. ft. to be constructed
in phases . The first phase (presently being completed) is pri-
marily retail building parallel to and facing Greenbrier Drive.
This building will be, in effect, a small shopping center with
3 (possibly 4) different retail tenants .
The second two phases consist of two buildings sited perpen-
dicular to Greenbrier Drive and located behind the first building.
These two building are planned for development as office/warehouse
space for numerous, yet to be identified, tenants. Initially clear-
span shell buildings are being constructed. This will allow us
to offer for lease multiple configurations of space. The general
plan being to divide the building front to rear with masonary part-
ition walls and then to improve the interior of each tenant' s space
to his specifications. The building is desinged to encourage develop-
ment of the front of each space into offices and the rear of the
space (with large overhead doors opening into a paved rear lot)
into warehouse for each tenant' s business inventory storage or
into service bays. In summary, we can not specify the number or
types of tenants who will be occupying the second two phases except
to say that physically they could not exceed 17 in number (with
perhaps half that number being a more realisic estimate) .
Finally, the project is designed as a commercial condominium
which may someday permit each individual business in the development
to purchase and own its private space with common use and maintenance
of the parking, signs, landscaping and the like.
We believe that a sign variance is needed for this project
because the unique nature of the development creates both public
saftey and aesthetic needs for using a special comprehensive sign
plan. If the County sign ordinance were rigidly applied to the
entire project treating it as a single business entity (because
it happens to be located on a single tax map parcel of land) we
would create either chaos for the public trying to find its way
to businesses within, or have to create some large number or size
of unrelated and confusing directory and facade signs . Or we could
be forced into a third alternative of going forward prematurely

with condominium division of the property creating, in effect,
multiple parcels for land each with its own signage rights.
After meeting with Andrew Evans and getting his input on behalf
of the County Zoning Department, we have followed their recommendation
and have tried to prepare a comprehensive sign plan for the entire
project. The plan should have sufficient flexibility to allow
multiple tenants to develop signage to their needs while keeping
overall size and visibility under strict comprehensive control.
The key to the plan is to provide an overall name or location
sign for "Greenbrier Square" which is close enough to the highway
that it will be immediately visible to all motorists who can identify
their business destination by this sign "address" . (Much like customers
look for the Fashion Square sign, enter the lot, then look for
the Sears sign) . The project has two entrances and thus requires
two identification signs, one for each entrance. The property line
on the east and a high bank on the west makes it a physical necessity
that these signs be located in the island across the front center.
This island is approximately 19 or 20 feet deep and thus these
signs must be located within 18 feet of the road, a variance of
12 feet. We have also chosen a vertical sign design that limits
intrusion of the sign to a minimum (only the width of the pylon
itself) .
In addition to the two identification signs we are also negot-
iating with one high traffic retailer who requires a free standing
frontage sign. We propose to locate this sign within the required
setback. The total square footage of all three frontage signs
will be less than the allowable maximum square footage allowed
under the ordinance.
We are also applying for a variance for the square footage
of facade signage which would be allowed under the ordinance if
we are treated as a single business. This is simply due to the
physical impossibility of identifying up to 21 different businesses
on the same parcel within the required maximum. To do so would
not only create a safety hazard but it may compel us to subdivide
the property in order to get adequate minimum identification for
each business .
In conclusion, we feel that the unique nature of this develop-
ment with multiple businesses on a single parcel of land compels
a variance which will allow adequate public identification of the
entire project. To enforce the ordinance literally would create
an undue hardship for us as developer, for the business owner
tenants and for the public who would be unable to easily locate
this destination. We see no possible adverse effect on any ad-
joining property owners and, in fact, forsee substantial benefit
to them by creating easy public identification of the project and
area thereby minimizing traffic congestion and public confusion.
We hope you will favorably consider our application.

EXPRESSING THE INTENT OF THE CITY COUNCIL
WITH REGARD TO THE USE OF CERTAIN PROPERTY
IN THE WESTFIELD SUBDIVISION IN ALBEMARLE COUNTY.
WHEREAS, by a contract dated June 25, 1968 , City Council
agreed that the City of Charlottesville would provide water,
sanitary sewer and natural gas service to a certain tract of
land in Albemarle County adjoining and lying northwest of
Route 29 North, known as Section I of Westfield Subdivision
(the 'Property") ; and
WHEREAS, one of the provisions of that contract restricts
land use on Lots comprising the Property to uses permitted by
Article IX (B-2 Business Districts) of the City Zoning Ordinance
of 1955 as it existed at the time

WHEREAS, that provision was written at a time when the City

of its corporate limits; and
WHEREAS, with the repeal of the City' s extraterritorial
land use powers and the development by the County of Albemarle
of a full-scale zoning and land use control program, and with
the sale of the City' s water and sewer lines to the Albemarle
County Service Authority which took placeain longer1975, itobecame
unnecessary and inadvisable for the City
to control land use on the Property or other tracts of land
similarly situated outside the corporate limits of the City; and
WHEREAS, the present owners of a portion of the Property
have asked the Council to clarify its position with respect to
enforcement of the aforesaid provision of the June 25, 1968
contract; now, therefore,
BE IT -RESOLVED by the Council of the City of Charlottesville,
Virginia, that the aforesaid land use control provision contained
in Paragraph 9 of the contract dated June 25, 1968 between the
City and Charles W. Hurt, et al. , of record in the Clerk's Office
of the Circuit Court of Albemarle County in Deed Book 455, at
Page 085, is deemed by the Council no longer to be enforceable;
and the Property which is the subject of that contract is no
longer deemed restricted to those uses set forth in Article IX
of Appendix II of the Code of the City of Charlottesville, 1965 ,
as amended, but is subject only to those provisions of the
zoning ordinance of the County of Albemarle currently applicable
to it.

THIS DEED, made this 22nd day of August, 1985, by and
between EDWARD H. DEETS, JR. , Sole Acting Trustee (the
"Grantor") ; and Brass, Inc. , a Virginia corporation and Frank
1 Lane Hereford, trading as Greenbrier Square, a joint venture
(the "Grantee") ; which has a mailing address of P.O. Box 7905,
Charlottesville, Virginia, 22906 and LLOYD T. SMITH, JR. ,
Attorney and Agent for O'Neill Bondholders Committee.
W I T N E S S E T H :
WHEREAS, by Deed of Release and Deed of Trust conveying
Substitute Security, dated October 15 , 1969 and recorded in the
Clerk's Office of the Circuit Court of Albemarle County in Deed
Book 476, page 29 (original in D.B. 465 , p. 561) , Frank A.
O'Neill and Caroline P. O'Neill, husband and wife, and O'Neill
Enterprises, Inc. , conveyed Lot B, Section One, Westfield
containing 4.34 acres, more or less, to Edward H. Deets, Jr. and
G. Ernest Thornhill, Trustees, (said G. Ernest Thornhill having
since resigned as Trustee) to secure the payment of an
indebtedness therein described; and
WHEREAS, default was made in the payment of said
indebtedness and the .Trustee was requested by Lloyd T. Smith,
Jr. , as Agent and Attorney for the Bondholders secured
thereunder, to foreclose the lien of said Deed of Trust by sale
of the property herein described; and
WHEREAS, said property was abandoned by Order of the United
States Bankruptcy Court, Western District of Virginia,
Charlottesville Division, dated August 22, 1980, a certified
copy of which Order is attached to and recorded with this deed;
and
WHEREAS, said Trustee, pursuant to the terms of said Deed
of Trust, did advertise said real estate for sale at public
auction to be held in front of the Albemarle County Courthouse
in Charlottesville, Virginia, on Wednesday, December 17, 1980,
at 11:00 AM, and at that time and place pursuant to said
advertisement the property was sold at public auction to Lloyd
1T. Smith, Jr. , Agent and Attorney for O'Neill Bondholders
( Committee at the price of $190,000.00, that being the last and
! highest bid received; and
WHEREAS, said Lloyd T. Smith, Jr. , Agent and Attorney for
11O'Neill Bondholders Committee has since agreed to sell the
' property to the Grantee and has requested the Trustee to make
conveyance directly to the Grantee; and
WHEREAS, the agreed purchase price has been paid in full
and the Grantee is now entitled to a deed.
NOW, THEREFORE, for and in consideration of the sum of TEN
DOLLARS ($10.00) and other good and valuable consideration, paid
by Lloyd T. Smith, Jr. , Agent and Attorney for Bondholders, to
the Trustee, the receipt of which is hereby acknowledged, Edward
H. Deets, Jr. , Sole Acting Trustee, does hereby GRANT, BARGAIN,
SELL and CONVEY with SPECIAL WARRANTY OF TITLE unto the Grantee,
all that certain lot of land situated west of U.S. Route 29 in
the Charlottesville Magisterial District of Albemarle County,
Virginia, which contains 3.1006 acres, and fronts a distance of
314.34 feet on the northeastern margin of Greenbrier Drive and
is further described as Parcel B-1 on a plat of a portion of
"Westfield" , titled "Plat Showing Subdivision Survey of Lot B,
Section One, 'Westfield' into Parcels B-1 and B-2,
Charlottesville District, Albemarle County, Virginia" , dated
August 26, 1985, prepared by Gloeckner, Lincoln and Osborne,
Inc. , attached hereto and recorded as a part of this deed.
The property hereby conveyed is a portion of that conveyed
to the Grantor by Frank A. O'Neill and Caroline P. O'Neill by a
Deed of Trust, dated October 15, 1969, of record in said Clerk's

Office in D.B. 476, page 29 (original D.B. 465, p. 561) and a
portion of Lot B conveyed in the aforesaid Deed of Release and

This property is conveyed subject to all easements,

record. By Contract dated June 25, 1968 , recorded in said

with the City of Charlottesville, Virginia, upon certain
conditions relating to the use and development of Section One,
"Westfield Subdivision" , which includes the property conveyed
hereby, in consideration of the City of Charlottesville

Pursuant to order entered herein July 29, 1980, and
due notice thereon by publication in two issues of The Daily
Progress , a newspaper published and of general circulation in
the City of Charlottesville, Virginia, the report and petition
' of Gray Williams , Esq . , Trustee of the captioned bankrupts , filed
July 7 , 1980, to abandon that certain parcel of land titled in

proof of a deficiency claim, because the collateral has not been
liquidated, and a contingent claim would unreasonably delay the
final aduir_istra_ion of the estate.

A RESOLUTION
EXPRESSING THE INTENT OF THE CITY COUNCIL
WITH REGARD TO THE USE OF CERTAIN PROPERTY
IN THE WESTFIELD SUBDIVISION IN ALBEMARLE COUNTY.
WHEREAS, by a contract dated June 25, 1968, City Council
agreed that the City of Charlottesville would provide water,
sanitary sewer and natural gas service to a certain tract of
land in Albemarle County adjoining and lying northwest of
Route 29 North, known as Section I of Westfield Subdivision
(the "Property") ; and
WHEREAS, one of the provisions of that contract restricts
land use on Lots comprising the Property to uses permitted by
Article IX (B-2 Business Districts) of the City Zoning Ordinance
of 1955 as it existed at the time of that contract and provided
that such land uses could not henceforth be changed by the
owners without prior approval of the City Council; and
WHEREAS, that provision was written at a time when the City
enjoyed certain extraterritorial land use powers under the Code
of Virginia, and when the City owned and operated water and sewer
utilities as well as natural gas distribution systems outside
of its corporate limits; and
WHEREAS, with the repeal of the City's extraterritorial
land use powers and the development by the County of Albemarle
of a full-scale zoning and land use control program, and with
the sale of the City' s water and sewer lines to the Albemarle
County Service Authority which took place in 1975, it became
unnecessary and inadvisable for the City any longer to attempt
to control land use on the Property or other tracts of land
similarly situated outside the corporate limits of the City; and
WHEREAS, the present owners of a portion of the Property
have asked the Council to clarify its position with respect to
enforcement of the aforesaid provision of the June 25, 1968
contract; now, therefore,
BE IT -- RESOLVED by the Council of the City of Charlottesville,
Virginia, that the aforesaid land use control provision contained
in Paragraph 9 of the contract dated June 25, 1968 between the
City and Charles W. Hurt, et al. , of record in the Clerk's Office
of the Circuit Court of Albemarle County in Deed Book 455, at
Page 085, is deemed by the Council no longer to be enforceable;
and the Property which is the subject of that contract is no
longer deemed restricted to those uses set forth in Article IX
of Appendix II of the Code of the City of Charlottesville, 1965,
as amended, but is subject only to those provisions of the
zoning ordinance of the County of Albemarle currently applicable
to it.
