STAFF REPORT - VA-86-36
APPLICANT: Joseph P . Aust, IV
TAX MAP/PARCEL: 58C/02-3 (Section 2 , Lot 3)
ZONING : RA (Rural Areas)
ACREAGE : 2 .02 acres
LOCATION: Located in Lewis Hill "West" Subdivision on
Vinton Court , . 1 mile west from the intersec-
tion of State Route 678
The applicant seeks a variance from Section 6 . 5 . 01 of the Albe-
marle County Zoning Ordinance . This section pertaining to setbacks
states :
"In the case of any subdivision which was approved pursuant to
Chapter 18 of the County Code prior to the adoption of this
ordinance and which was of record at the time of the adoption
hereof , the rear , side and front yard and setback regulations
of the Zoning Ordinance in effect at the time of such approval
shall apply to all lots within such subdivision . "
The applicant wishes to reduce the side yard setback from twenty-
five (25) feet to twenty-one (21) feet .
Mr . Aust has obtained a building permit for a detached garage ,
which is currently under construction . Also a part of that building
permit is the addition of a front porch which extends across the
entire width of the house .
Now, Mr . Aust would like to extend the house porch addition over
to, and attach the garage , thus making the attached garage in viola-
tion of the side yard setback .
RECOMMENDATION
The application should be denied :
1) The applicant has not shown by evidence that a strict appli-
cation of the Zoning Ordinance would produce a clearly demon-
strable hardship approaching confiscation as distinguished
from a special privilege or convenience .
2) The applicant has not demonstrated that the hardship is unique
to the property in contradistinction to other properties in
the same zoning district and general vicinity. The require-
ment the applicant seeks is shared by all properties zoned
RA - A-1 .
3) The applicant has not provided evidence to demonstrate that
the authorization of this variance will not be of substantial
detriment to the adjacent properties or that the character
of the district will not be altered .

In the event the Appeals Board should find cause to entertain
the applicant ' s request , the following condition should be con-
sidered :
1) The garage area as such should not be converted to habitable
space .
