HomeMy WebLinkAboutVA198600031 Action Letter As-Built Reviews 1986-09-10 STAFF REPORT - VA-86-31 APPLICANT: Richmond-Albemarle Limited Partnership c/o Ruby Furr , Arbor Crest Apartments TAX MAP/PARCEL: 61/39 ZONING: R-15 ACREAGE: 3. 878 acres LOCATION: West side of Hydraulic Road, ± 300 feet north of the intersection of Route 656 and Route 743 The applicant requests variances from Sections 18. 3 and 4. 15.3 . 5 of the Albemarle County Zoning Ordinance. These sections pertaining to permitted signs in the Residential District (R-15) and minimum yard requirements state: "4. 15.3 . 5 Residential R-10 and R-15; Planned Residential Development (PRD) ; and Planned Unit Development (PUD) Identification Signs: Provided: (A) not more than two (2 ) square feet in area. " "18. 3 AREA AND BULK REGULATIONS Yards, minimum: Front , 25 feet . " The applicant has an already existing identification sign which is twelve (12) square feet in aggregate area and is located twenty-one (21) feet from the road right-of-way. Size and location of the existing sign were approved by the Board of Zoning Appeals via variance , VA-83-63 . The variance was conditional upon the sign being removed in three (3) years. The advertised variance request was the same as the 1983 application, but the applicant ' s representative expressed to the staff that the existing sign is satisfactory. RECOMMENDATION The variances should be denied for cause: 1) The applicant has not presented supporting evidence that the hardship is unique to the property in contradistinction to other prop- erties in the same zoning district and general vicinity. All properties zoned R-15 share the same requirement . 2) The applicant has not provided sufficient evidence to show that the strict application of the Zoning Ordinance would produce a clear- ly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. STAFF REPORT - 2 Arbor Crest Apartments 3) The applicant has not provided sufficient evidence to demonstrate that the authorization of this variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered. Should the Board find cause to entertain the request , the following recommendations are made: 1) The approval be given to the existing twelve (12) square foot sign located twenty-one (21) feet from the road right-of-way. 2) Variance, VA-83-63, be voided. Tax Map 61, Parcel 39 Dear Sir: This letter is to inform you that on September 9, 1986 , during the regular meeting of the Albemarle County Board of Zoning Appeals , your application for VA-86-31 was approved. This variance approval allows relief from Section 18. 3 of the Albemarle County Zoning Ordinance to allow a freestanding sign to be located 8 feet from highway right-of-way , a variance of 17 feet . • Also, the variance allows relief from Section 4. 15. 3. 5 to allow an identification sign to be 24 square feet , a variance of 22 square feet .
