The next variance to come before the Board was VA-78-18, Izetta Zimmer
Dotts.
Mr. Dick read the staff report at this time.
VA-78-18. Izetta Zimmer Dotts, Tax Map 31, Parcel 5D, Zoned A-1,
Acreage 2.00. The applicant requests relief from Section 2-4 of
the County Zoning Ordinance to allow a single family residence to
be located on the parcel with a lot width of 93 feet; a variance
of 57 feet.
Mr. Walter Dotts was present to represent the application. He stated
he lived on the adjoining property and there were three principle advantages
to be gained if the variance is granted. Mr. Dotts presented photographs
showing a spring and a stream flowing out of it. The lot is very much like
a pipestem, and where the bowl of the pipe comes out of the stem is where the
spring is located, and the stream runs southwest from it. With the minimum
building line in its present location, the septic field would pollute the
spring and stream. It would also be necessary to build a road which would
probably destroy the spring. If we move the minimum building line up
into the woods, we could stay far enough from the spring and stream to
avoid polluting it and further it would avoid building an access road. All
the property owners contacted would like to see the spring and stream
protected. Mr. Dotts stated the house he intended to build would fit on
the lot not creating a hardship meeting the side setbacks. -✓

Mr. Bobby Marion was present to speak in favor of the variance
requested by Mr. Dotts.
The public hearing was then closed so the Board could take action.
Mr. Roberson made a motion to grant the variance.
Mr. Smith seconded the motion on the strength of Mr. Bailey's
recommendation.

The next item to come before the Board was VA-78-19, Henry J. Browne.
Mr. Dick read the staff report at this time.
VA-78-19. Henry J. Browne, Tax Map 60E(1) , Parcel Cl, Zoned R-1 ,
Acreage 1.658. The applicant requests relief from Section 4-3 of
tom, the County Zoning Ordinance to allow an addition to a single family
residence to be located 22.34 feet from the property line; a variance
of 7.66 feet.
Mr. Henry Browne was present to represent his application. He stated
the house in question was an existing structure built in 1932 before zoning
requirements were adopted. It is one of a few parcels of land in Farmington
with a 60' right-of-way. Most right-of-ways there are smaller. Mr. Browne
stated the only way the addition could be placed on the house and use it
architectually without having to walk diagonally through a living room in
front of a fireplace is to place it on the uphill side. Architectually, the
compatability of the style is being maintained and the building already sits
over the zoning setback requirement which was placed on it probably 15 years
ago.
Mr. Browne presented pictures of the house now and also sketches of

ACREAGE: 2.00 acres
LOCATION: South side of State Route 764, ± . 1 mile from the
intersection of Rt . 663 & Route 764
The applicant requests a variance from Section 10. 4 to allow
a single-family dwelling to be constructed 15 feet from the side
property line, a variance of 10 feet . Section 10. 4 pertaining to
setbacks in the RA District states:
"10. 4 Area and Bulk Regulations. . .
Yards, minimum
Side 25 feet . . . "
In May, 1978 the Board of Zoning Appeals reviewed an applica-
tion on this very same lot concerning the location of a single-
family residence on a lot of less than 150 feet width at the
building setback line. Section 2-4 of the ordinance in effect at
the time the variance was made required a minimum lot width at
the setback line of 150 feet or more .
The Board of Zoning Appeals granted a variance of 57 feet ,
allowing a lot width of 93 feet .
Additional information pertaining to the applicant ' s lot is
related in a memo by Harvey Bailey (former County Engineer) . The
septic field would have to be located within 50 feet of an exist-
ing spring and stream to serve the residence beyond the minimum
setback line. Mr. Collins representative of the local Health
Department agreed with Harvey Bailey that a better situation would
be to locate the house on the northern portion of the lot . A
combination of less runoff from an entrance road and better protec-
tion of the spring and stream would be accomplished by locating
the proposed residence on the narrow or northern portion of the
lot .
Current owner, P. David Foster, wishes to construct a ranch
style dwelling on the northern portion of the lot 15 feet from a
side property line , requiring the benefit of a 10 foot variance.
RECOMMENDATION
The application should receive consideration from the Board:
1) The applicant has not shown by evidence that
a strict application of the zoning regulations
would produce a hardship approaching confiscation
as distinguished from a special privilege or
convenience

2) The hardship is unique to the applicant ' s property
which is twofold. First of all the property is
shaped in a manner not common to others of the
vicinity and district , and which involves a
spring and stream. Secondly, the Board of Zoning
Appeals has granted relief by variance for the
width of the lot to be 93 feet , providing a
diminished buildable area.
3) The granting of the variance would not be of
any detriment to the adjacent properties or
alter the character of the district . A
proposed location of the house on the northern
portion of the lot would be as the memo
suggested, cause less stormwater runoff, and
provide more polution protection for the
location of the septic system from the
spring and stream.

Reference is mde to Mr. Dotts' petition to be heard on a building line
variance for a lot designated as 31-5 on the County tax map. Mr. Dotts
has requested me to give you my opinion on the location of the sewage
system that will serve this lot.
Mr. Collins, sanitarian, called me on the location of a septic system.
In order to serve a dwelling site on the area provided, as shown by a plat
of record (D.B. 592-412) , the septic field must he installed as close as
fifty (50) feet to an existing spring and stream which flows across the lot
near the minimum building line. Since the lot was of record prior to the
enactment of the Runoff Control Ordinance, this variance can be granted.
• However, I agree with Mr. Collins that the better solution, as far as
sanitation is concerned, would be to locate the dwelling on the north end
of the lot. The septic field can thereby be located a full 200 feet from
the stream. Also, the road required to serve the dwelling would be only
about one-third that required to reach the designated house site, which
would also be beneficial to the aims of the Runoff Control Ordinance.
