of its intersection with Rt . 742 , zoned A. The applicant seeks
relief from Sections 10.4 and 30.5.6.2 of the Albemarle County
Zoning Ordinance to reduce the side yard measurement from twenty-
five (25) feet to ten (10) feet and to reduce the setback in the
Scenic Area-Highways District from one hundred fifty (150) feet
to fifty-four (54) feet to allow construction of an addition to
a single-family dwelling.

STAFF REPORT - VA-86-44
APPLICANT: Cyrus Mickey Wichael

LOCATION: West side of State Route 29 South, approximately
2 miles south of the intersection of Route 20
and Route 742
The applicant seeks relief from Sections 10. 4 and 30.5.6.2 of
the Albemarle County Zoning Ordinance to reduce the side yard
measurement from 25 feet to 10 feet , and to reduce the setback in
the Scenic Area-Highways District from 150 feet to 54 feet to
allow construction of an addition to a single-family dwelling.
30. 5. 2.2 Scenic-Area Highway Overlay Districts are hereby
established along the following corridors in Albemarle
County for a distance of 150 feet on each side of the
right-of-way
b) Virginia Route 20 from Interstate 64 south to the
corporate limits of the town of Scottsville .
30. 5.6.2 Scenic-Area Highways
30. 5.6.2. 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls, except as
hereafter provided in the case of certain signs,
shall be constructed within any Scenic-Area Highways
Overlay District .
The applicant proposes to construct an addition to the rear
portion of an existing single-family residence, thus seeking both
a setback from the 25 foot side yard setback, and the 150 foot
Scenic-Highway setback.
Being that the single-family residence is currently located
within the required 150foot setback, an addition could not be
added to the structure without a variance .
A "very limited"area addition to the south side of the residence
would be possible without assistance of a side yard variance, but
would require relief from the Scenic-Highway setback.
The property adjacent to the applicant ' s on the south side
is presently a vacant lot .
A similar residence such as the applicant ' s is located
approximately 32 feet beyond the north side property line.

RECOMMENDATION
The applicant ' s request should be approved for cause:
1) The applicant can show by existing location that
it would not be feasible to add an addition without
the benefit of a variance , thus demonstrating a
hardship.
2) With the exception of the immediate neighboring
lots, most of the general vicinity and lots in the
same zoning district have more area than .69 acres.
The applicant ' s lot frontage and width is only 75
feet , which is less than 1/3 the current minimum
requirement . This characteristic is not shared by
the majority of the neighboring properties and of
the zoning district.
3) The applicant has not provided evidence the
authorization of the variance will not be of
substantial detriment to the adjacent properties
or that the character of the district will not
be altered.
