TAX MAP/PARCEL: 61/23A ZONING: R-10 ACREAGE: 1.429 acres LOCATION: East side of Route 743 , ± . 1 mile north of its intersection with Whitewood Road The applicant seeks a variance from Section 4.6.3 .2 of the Albemarle County Zoning Ordinance . This section states: "4 .6.3 Lots, Yards Adjacent to Street 4.6 .3 .2 Other yards adjacent to streets shall have a minimum width or depth, as the case may be, of eighty (80) percent of the minimum frontyard depth required in the district in which the lot is located. This provision shall apply to lots in the RA and residential districts only. " The applicant proposes to construct a fourteen (14) unit apartment building and seeks a reduction of the setback on the north side of the structure from the minimum requirement of twenty (20) feet to fifteen (15) feet . The right-of-way on the north side of the applicant ' s property serves as an access to the Lincoln Heights Cemetary. The applicant states that the slope of the property prohibits the placement of the structure from being shifted the five (5) feet . The applicant ' s only other option is to reduce the spatial dimensions of the proposed structure. RECOMMENDATION The application should be denied for cause: 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. The applicant ' s perceived hardship is created by the spatial dimensions of the proposed structure , a condition totally under the control of the applicant . The staff believes the structure can be redesigned so as to comply with all zoning requirements. 2) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity.
