APPLICANT: Reynovia Land Trust

LOCATION: Route 20
The applicant seeks a variance from Section 3 .0 of the
Albemarle County Zoning Ordinance. This section contains the
definitions of the Zoning Ordinance. The applicant specifically
seeks a variance from the definition of a subdivision sign, which
states:
"3 .0 Definitions . . .
Sign Subdivision: A sign, not illuminated, 60
square feet or less in aggregate area, identifying
a subdivision and located thereon at the entrances
to such subdivision. Said sign shall be not greater
in height than 6 feet and setback from any right-of-
way for proper sight distance. "
The applicant seeks a variance to allow the proposed subdivi-
sion sign to be illuminated from an external light source.
RECOMMENDATION
The application should be denied for cause:
1) The applicant has not demonstrated that his
perceived hardship is unique to his property
in contradistinction to other properties in
the same zoning district and general vicinity.
The same requirement is shared by all other
properties zoned AB-€5C. pu,?,
2) Sufficient evidence to show that a strict
application of the Zoning Ordinance would
produce a clearly demonstrable hardship
approaching confiscation as distinguished
from a special priviledge or convenience
has not been provided.
3) The applicant has not provided evidence to
demonstrate that the authorization of the
variance will not be of substantial detriment
to the adjacent properties or that the charac-
ter of the district will not be altered.

In the event the Board of Zoning Appeals finds cause to
approve the applicant 's request , the following conditions of
approval should be considered:
1) That the sign (s) be constructed of wood and/or
masonry materials
2) That illumination shall be from an external light
source.
