APPLICANT: JWK Properties, Inc.
TAX MAP/PARCEL: 103/1E
ACREAGE: 326. 23 acres
ZONING: RA (Rural Areas)
LOCATION North side of Route 627, approximately .75 mile
southwest of its intersection with Route 795
The applicant seeks a variance from Section 10 .4 of the
Albemarle County Zoning Ordinance . This section states:
"10. 4 Area and Bulk Regulations
Yards, minimum
Front : 75 feet . . . "
The applicant proposes to construct a gate house at the entrance
to his property and seeks a variance of the front setback requirement
from the minimum measurement of 75 feet to 58 feet . The proposed gate
house , measuring 10 feet by 15 feet , is to be utilized by the appli-
cant ' s security personnel . There are no topographical features or
other circumstances which prohibit the applicant from complying with
the front yard setback requirement .
RECOMMENDATION
The applicant ' s request should be denied for cause:
1) The applicant has not presented supporting
evidence that the hardship is unique to the
property in contradistinction to other prop-
erties in the same zoning district and general
vicinity.
2) The applicant has not provided sufficient
evidence to show that the strict application
of the Zoning Ordinance would produce a clear-
ly demonstrable hardship approaching confiscation
as distinguished from a special privilege or
convenience . The requirement the applicant
seeks relief from is shared by all properties
zoned RA.
3) The authorization of the variance request would
not be of detriment to the adjacent properties,
however, the character of the zoning district
would be altered through this abrogation of the
front setback requirement .
In the event the Board of Zoning Appeals finds cause to
approve the applicant ' s request , a condition limiting the variance
to the construction of the gate house only should be considered.
