Dear Mr. Burgess :
Please find enclosed the application for variance necessary
for the expansion of Brown' s Market in Esmont. The owner
and operator of the store, Mr. Brown, would like to double
the size of the building and improve the appearance and
efficiency of the business. We think that improvements
to the building will be to the advantage of the community
and the scenic appearance of Route 6 as well as the long
term interest of the owner.
I enclose a sketch of the proposed enlarged building.
The materials will be either brick or a hard-coat stucco.
We are considering a standing seam metal roof but we may
use a top grade composition shingle roof depending on a
detailed cost estimate and maintenance figures. Please
note that the inclusion of a public restroom will allow
the removal of the portable toilet now sitting near the
shoulder of Route 6. The overhang at the front of the
building should help to screen the vending machines. Mr.
Brown would like to add a canopy over the comas pumps. This
will be detailed on the ardhitecturaIAdrawings to be shown
at the hearing. Some signage is intended _for the ends of
the ,building.
The second aspect of the variance is that it is impossible
to provide more parking on this site without extensive earth
work. Needless to say this would not he feasible for a
small business of this type. As the business has no serious
parking nrablem now, and the expansion of the store will
increase the actual retail area by only a modest amount,
we ask that any requirement for additional parking be waived.
The expansion of the building will give Mr. Brown better
storage, amenities, and operating efficiency with only a
small net gain in retail space. Currently there is room
to park__seven or ,,ejght cars off the highway right of way.
We have a civil engineer working with us and hope to avoid
the complication and expense to the owner of preparing a
formal site plan.

intersection with Rt . 627
The applicant seeks a variance from Sections 30 . 5 . 6 . 2 . 1
and 30 . 5 . 7 . 2 (c) of the Albemarle County Zoning Ordinance .
These sections state :
"30 . 5 . 6 . 2 SA-HIGHWAYS
30 . 5 . 6 . 2 . 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls , except as here-
after provided in the case of certain signs , shall be con-
structed within any SA-highways overlay district .
30 . 5 . 7 . 2 REGULATION OF NUMBER, HEIGHT, AREA, TYPES OF SIGNS
The following regulations shall be in addition to Section
4 . 15 . 3 generally and shall be further limitation on regula-
tions contained in sections 4 . 15 . 3 . 6 and 4 . 15 . 3 . 7 , specifi-
cally.
c . Business wall signs shall be limited to twenty (20) feet
in height above grade , thirty-five (35) square feet per
single sign face , and to one (1) sign per separate highway
frontage . "
The depth of the SA-HIGHWAYS Overlay District is established
in Section 30 . 5 . 2 . 2 which states :
"30 . 5 . 2 . 2 SA-HIGHWAYS
SA-HIGHWAY Overlay Districts are hereby established along
the following highway corridors in Albemarle County for a
distance of one hundred fifty (150) feet on each side of
the right-of-way :
c . Virginia Route 6 from the corporate limits of the Town
of Scottsville westward through several discontinuous
portions of Albemarle County. "
The applicant at present has a non-conforming country store
and proposes to construct the following:
1) A canopy to cover the existing gasoline pump area ,
2) A canopy attached to the front of the existing structure ,
and
3) a twenty (20) foot by forty (40) foot addition to the rear
of the existing structure .

Based on the drawings submitted by the applicant , it appears
that the proposed additions will improve the visual appearance of
the structure . The applicant seeks a reduction of the Scenic High-
way setback from one-hundred fifty (150) feet to nineteen (19) feet
and to increase the number of wall signs permitted from one (1)
sign to three (3) signs .
In that the scenic highway setback (150 feet) exceeds the
depth of the applicant ' s property, no construction can be commenced
without benefit of a variance . It appears that the creation of the
SA-HIGHWAYS Overlay District has created a situation wherein the
applicant has been denied the reasonable use of his property.
RECOMMENDATIONS
The applicant ' s request for a reduction of the setback require-
ment from one-hundred fifty (150) feet to nineteen (19) feet should
be approved .
The applicant ' s request to increase the number of wall signs
permitted from one (1) sign to three (3) signs , should be denied
for cause :
1) The applicant has not provided sufficient evidence to
show that a strict application of the Zoning Ordinance
would produce a clearly demonstrable hardship approaching
confiscation as distinguished from a special privilege or
convenience .
2) The applicant has not demonstrated that the perceived hard-
ship is unique to his property in contradistinction to
other properties in the same zoning district and general
vicinity. The requirement the applicant seeks relief from
is shared uniformly by all properties located in a SA-
HIGHWAYS Overlay District .
3) The applicant has not provided evidence to demonstrate
that the authorization of the variance will not be of
substantial detriment to the adjacent properties or that
the character of the district will be altered .
In the event the Board of Zoning Appeals finds cause to approve
the applicant ' s sign request , the following conditions of approval
should be considered :
1) that the applicant agree not to erect any other type of
signs on the property
2) that the signs be constructed of wood or metal
3) that any illumination of the signs be from an external
light source .
