during the regular meeting of the Albemarle County Board of
Zoning Appeals , your application for VA-86-33 W68 approved ,
This variance approval allows relief from Section
30 . 5 . 6 . 2 of the Albemarle County Zoning Ordinance to allow
off-street parking to be located within the required set-
back area of the Scenic Areas Overlay District .

APPLICANT: Piedmont Tractor Company, Inc .
TAX MAP/PARCEL: 60/25A
ACREAGE: 3 . 89 acres
ZONING: C-1 (Commercial)
LOCATION: West side of Route 250 , + . 2 mile south of its
intersection with Route 601 .
The applicant seeks a variance from Section 30 . 5 . 6 . 2 . 2 of the
Albemarle County Zoning Ordinance . This section, pertaining to
off-street parking in the Scenic Area - Highways Overlay District ,
states :
30 . 5 . 6 . 2 SA - Highways
30 . 5 . 6 . 2 . 2 "No off-street parking or loading shall be allowed
closer than fifty (50) feet to the right-of-way line of a SA-
highway which is all or part of off-street parking facilities
required or designed to accommodate more than two (2) motor
vehicles . "
The applicant proposes to enlarge the existing off-street parking
area and seeks a variance from the required fifty (50) foot setback
requirement . The parking area will be situated approximately thirty
(30) feet from the right-of-way line at the closest point . The
existing non-conforming structure is situated seventy (70) feet
from the right-of-way line .
RECOMMENDATION
The application should be denied for cause :
1) The applicant has not demonstrated that a strict application
of the Zoning Ordinance creates an undue hardship in the
reasonable use of the property . Adequate off-street parking
to support the use exists on the property.
2) The requirement the applicant seeks relief from is shared by
all properties in the SA - Highways Overlay District .
3) The granting of the applicant ' s request would not be of sub-
stantial detriment to the adjacent properties . However , the
granting of the variance would undermine the intent of the
Zoning Ordinance in regards to the SA-Highways Overlay
District .
