This letter is to notify you, as adjoining property owners,
that Donald W. Foster property described as Tax
Map 26 , Parcel (s) l2A , Zoned RA , has made
application for vA-87-2 , requesting relief from
Section (s) 30 . 5 . 5. 2 d (6b) of the Albemarle County
Zoning Ordinance, as follows:
VA-87-2 . Donald W. Foster (owner) , property known as Tax Map 26 ,
Parcel 12A, located on the south side of Route 614 , + .1 mile
SE of its intersection with Route 674 , Zoned RA.. The applicant
seeks a variance from Section 30 . 5 . 5 . 2 d (6b) of the Albemarle
County Zoning Ordinance to allow a bridge to be constructed over
the Moormans River.
A public hearing will be held by the Board of Zoning Appeals
on February 17 , 1987 , at 3 :00 p.m. , in Meeting Room #7, Second
Floor, County Office Building, 401 McIntire Road, Charlottesville ,
Virginia.
This application is made available for your review in the
Albemarle County Zoning Office , 401 McIntire Road, Charlottesville ,
Virginia.

Frank Kessler was present to represent M. A . D . Partnership .
He stated that if the Board would grant the approval that they
would certainly agree to everything that the Zoning Administrator
had requested . He stated that the property was very unique because
it was surrounded on all three sides by roads . He stated that they
needed the sign for identification for Real Estate III .
The Chairman invited public comment .
There being no further comment , the matter was placed before
the Board .
Mr . Kennedy stated that he would like to visit the site to
look at the situation . He suggested that the Board defer the
application .
Mrs . Huckle made a motion to defer the application to the
next regular meeting so the Board could take a look at the site .
Mr . Roberson seconded the motion , which carried unanimously .
The next application before the Board was VA-87-02 , Donald
Foster .
Mr . Evans read the staff report .
VA-87-02 . Donald W. Foster , property known as Tax Map 26 ,
Parcel 12A, located on the south side of Rt . 614 , +/- . 1
mile southeast of its intersection with Rt . 674 , zoned RA .
The applicant seeks a variance from Section 30 . 5 . 5 . 2 (6b)
of the Albemarle County Zoning Ordinance to allow a bridge
to be constructed over the Moormans River . (See the
attached copy of the staff report . )
Donald Foster was present to speak for the application . He
stated that he bought 8 acres from Orbin Carter which was landlocked .
He stated that he owned property on both sides of the river and had
access to the property . He stated that only the chimney remained
on the house , and the ford was still visible . He stated that he

wanted to build a bridge above the river . He stated that it would
be subject to approval by the state .
Mr . Payne stated that this was located in a Scenic River Over-
lay , and that the applicant needed the variance approval in order
to be able to apply to the Board of Supervisors for a special use
permit . He stated that the Special use permit could not be
issued because there was not an existing house on the property .
The Chairman invited public comment .
There being no further public comment , the matter was placed
before the Board .
Mr . Van Fossen made a motion that the variance be granted .
He stated that the hardship was that the applicant could not
adequately use his property. He made the variance approval contin-
gent on the special use permit approval .
Mr . Roberson seconded the motion , and the role was called .

The next application before the Board was VA-87-3 , Hydraulic
Professional Building Partnership .

VA-87-3 . Hydraulic Professional Building Partnerhsip , pro-
perty known as Tax Map 61 , Parcel 27A, located at 2774
Hydraulic Road , zoned CO . The applicant seeks a variance
from Section 21 . 7 . 1 of the Albemarle County Zoning Ordinance
to reduce the setback for a freestanding business sign from
thirty (30) feet to nine (9) feet . (See the attached copy
of the staff report . )
