Foster AX MAP/PARCEL: 16/12A ONING: RA (Rural Areas) CREAGE: 8.3 Acres ,OCATION: South side of Rt 614, + .1 miles southeast of its intersection with Rt 674 The applicant seeks a variance from Section 30.5.5.2 d(6b) of the Albemarle County Zoning Ordinance. This section, pertaining to Scenic Area-Overlay District uses, states: "30.5.5 Permitted uses by Right and Special Permit 30. 5. 5.2 (d) The following uses by Special Use Permit only; 6 . Bridges, causeways and other similar structures designed for pedestrian and/or vehicular access; provided that the Board of Supervisors shall find, by clear and convincing evidence in addition to the findings required by Section 31.2.4. 1 , that : (a) such bridge on other structure is to be located at the site of an existing bridge, ford or other stream crossing; (b) such existing crossing is regularly used, and such bridge or other structure is to be used, as to the sole means of access to one or more existing, lawfully occupied dwellings; . . . . " The applicant proposes to construct a bridge across the Moorman River at the site of an existing ford. At present , there is not an existing, occupied dwelling located on the property. Only the chimney remains from the old dwelling which was originally served by the ford. The applicant seeks a variance enabling the construction of a bridge to serve a property where a occupied dwelling does not presently exist . The actual construction of the bridge will be contingent upon approval of Special Use Permit #86-95. RECOMMENDATION The applicant ' s request should be approved contingent on the approval of the SP #86-95. STAFF REPORT - VA-87-02 OWNER: Donald W.
