County Code section 17-410 and Virginia Code §62.1-44.15:34 requires the VSMP authority to
act on any VSMP permit by issuing a project approval or denial. This project is denied. The
rationale is given in the comments below. The application may be resubmitted for approval if all
of the items below are satisfactorily addressed. The VSMP application content requirements can
be found in County Code section 17-401.
A. Stormwater Pollution Prevention Plan (SWPPP)
The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must
contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary.
1. The SWPPP appears to be acceptable at this time. (Rev. 4) The SWPPP will need to be updated for
the plan revisions. This includes a revised registration statement to reflect the additional area to
be disturbed. (Rev. 5) The registration statement was not found with the submitted materials.
Please include a 2019 Registration Statement.
B. Pollution Prevention Plan (PPP)
The PPP content requirements can be found in County Code section 17-404.
1. The PPP appears to be acceptable at this time. (Rev. 4) See above. (Rev. 5) Updated copies of the
SWPPP and PPP will be needed prior to issuance of a grading permit.
C. Stormwater Management Plan (SWMP)
VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a

SWMP. This plan is disapproved, and the reasons are provided in the comments below. The
stormwater management plan content requirements can be found in County Code section 17-403.
1. The plan referenced for the stream crossing (WP0200900061) is no longer under review and has
expired. A new application will need to be submitted and approved prior to approval of this plan,
along with a mitigation plan and a floodplain development permit for the stream crossing. (Rev. 1)
Comment partially addressed. See new comments below.
2. Area used for the Forest and Open Space credit in the VRRM worksheet will need to platted and
deeded (or bonded) before approval. (Rev. 1) Response noted.
3. Nutrient credits will need to be purchased before approval. Please contact Ana Kilmer for
requirements before purchasing credits. (Rev. 1) Response noted.
4. Provide a landscaping plan (BMP Spec. 14.6.7) and a maintenance schedule (BMP Spec. 14.9) for
the wet ponds. The ponds and landscaping will also need to be reviewed by Planning and the
ARB. (Rev. 1) Comment partially addressed. (Rev. 2) Plans are currently under review by
the ARB.
(Rev. 1) Comment from Margaret Maliszewski, ARB:
Consistency of this plan with ARB requirements cannot be determined until the required ARB
application is submitted and reviewed by the ARB. See the February 10, 2017 ARB action letter
for more information.
(Rev. 3) Comment Addressed.
(Rev. 4) This plan may require additional ARB review. The applicant will be notified of
ARB comments when they are received.
(Rev. 5) Comment addressed.
Despite the retaining walls with handrails, a safety bench and an aquatic bench will still be
required. Aquatic benches should also be no deeper than 18" and should be 6-10' wide. (Rev. 1)
Comment addressed.
Revision 1 Comments
6. The stream crossing will need to meet the conditions outlined in the approval letter of SP-2006-
00034. The culvert design will also need to be shown on the road plans as it will require VDOT
approval. (Rev. 2) Response noted. A grading permit will not be issued until both VDOT and
the County have approved the culvert crossing and the road plans. (SP2006-34, Conditions 1
& 2) (Rev. 3) Response noted.
7. The culvert calculations on sheet 8 reference a previous plan. Please provide all calculations and
data with these plans and the road plans, as the previous plans are not approved. (Rev. 2)
Response noted. These will also need to be included with the road plans. (Rev. 3) Comment
addressed. Any changes from the FDP or road plan reviews will need to be reflected on this
plan.
8. Include the offsite area on the mitigation plans. The offsite area may require an easement or
maintenance agreement. (Rev. 2) The sheets showing the proposed mitigation areas (and other
needed information such as the access roads to the ponds) have been removed from this set.
Please include these sheets and show the mitigation areas from the provided packet on these
sheets. The Mitigation packet will also need to be provided to the ARB and the Natural
Resources Manager for review and approval. (SP2006-34, Conditions 5 & 6)

approval from the NRC Manager. (Rev. 5) Comment addressed.
9. A Floodplain Development Permit application will need to be submitted and approved
(18.30.3.12). (Rev. 2) Response noted, however there is no record of a FDP application. (Rev.
3) The FDP application is currently under review. (Rev. 4) The FDP has been approved.
10. FEMA approval of the flood map revision is required before a grading permit will be issued (SP
condition). (Rev. 2) Comment addressed.
11. Please provide a copy of all permits (DEQ, Army Corps of Engineers, VMRC) for this project.
Please also supply copies of the applications for county records. (Rev. 2 & 3) Response noted.
(Rev. 5) Comment addressed.
12. Provide a low maintenance, non -grassed groundcover on all slopes steeper than 3:1. (Rev. 2)
Comment not addressed. The note was not found on the included sheets (please let me know
if I overlooked it) and should also be included on the ESC sheets and the grading sheets (see
comment 8). (Rev. 3) Comment partially addressed. The note was not found on the ESC
sheets. (Rev. 4) Comment not addressed. (Rev. 5) Comment addressed.
Revision 4 Comments
13. A new Stormwater Management Agreement will be needed for the adjacent parcel. (Rev. 5)
Response noted.
14. Show on the plans the easements mentioned in the Proffers allowing the school lot use of Pond A
(Pond 10 in the proffers). [ZMA201300014.IX] (Rev. 5) Comment addressed.
15. Provide a copy of the revised calculations. (Rev. 5) Comment addressed.
D. Erosion and Sediment Control Plan (ESOP)
Virginia Code §62.1-44.15:55 requires the VESCP authority to approve or disapprove an ESOP.
This plan is disapproved, and the reasons are provided in the comments below. The erosion control
plan content requirements can be found in County Code section 17-402.
The ESC measures from the stream crossing plan should also be shown on this plan. (Rev. 1)
Comment partially addressed. Include ESC measures to protect the stream during the
construction along 29. (Rev. 2) Provide additional detail on the culvert installation (plan
views showing the stream diversion and culvert installation process). Also, both culverts
should be installed at the same time to limit the amount of time the stream is disturbed.
(Rev. 3) Comment addressed.
The VSMP permit application and all plans may be resubmitted for approval when all comments have
been satisfactorily addressed. For re -submittals please provide 2 copies of the complete permit package
with a completed application form.
Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to
discuss this review.
Process;
After approval, plans will need to be bonded. The bonding process is begun by submitting a bond estimate
request form and fee to the Department of Community Development. One of the plan reviewers will
prepare estimates and check parcel and easement information based on the approved plans. The County's
Management Analyst will prepare bond agreement forms, which will need to be completed by the owner
and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need

to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to
obtain all the correct signatures and forms.
Stormwater Management Facilities Maintenance agreements will also need to be completed and recorded.
The County's Management Analyst or other staff will prepare the forms and check for ownership and
signature information. The completed forms will need to be submitted along with court recording fees.
After bonding and agreements are complete, county staff will need to enter project information in a DEQ
database for state application processing. DEQ will review the application information based on local
VSMP authority approval. At this time, the DEQ portion of the application fees will need to be paid
directly to the state. For fastest processing, this is done electronically with the emails provided on the
application. DEQ should notify applicants with instructions on how to pay fees. When DEQ approves the
application, they will issue a permit coverage letter. This should be copied to the county.
After DEQ coverage is issued, via the coverage letter, the County can hold a pre -construction conference.
Applicants will need to complete the request for a pre -construction conference form, and pay the remainder
of the application fee. The form identifies the contractor and responsible land disturber, and the fee
remaining to be paid. This will be checked by county staff, and upon approval, a pre -construction
conference will be scheduled with the County inspector. At the pre -construction conference, should
everything proceed satisfactorily, a joint VSMP and grading permit will be issued by the County so that
work may begin.
