The applicant seeks a variance from Section 6.5 of the Albemarle County
Zoning Ordinance . This section, pertaining to nonconforming lots, states:
"6.5.01 In the case of any subdivision .. which was approved
pursuant to Chapter 18 of the County Code prior to the
adoption of this ordinance and which was of record at the
time of the adoption hereof , the rear , side and front yard,
and setback regulations of the Zoning Ordinance in effect
at the time of such approval shall apply to all lots within
such subdivision. "
The applicant proposes to construct a'twelve (12) foot by eleven (11) foot
addition to the rear of his dwelling and seeks a reduction of the rear yard
from the minimum requirement of thirty-five (35) feet to approximately
six (6) feet . The proposed addition will serve as an expansion of the
kitchen area. The applicant ' s need for a variance is caused by the original
placement of the dwelling. The staff is aware of a restrictive covenant
in the Bellair Estates Subdivision which prohibits development within ten (10)
feet of any property line . The applicant should be made aware that any
approval granted by the Board of Zoning Appeals would not supersede the
restrictive convenants.
RECOMMENDATION
The applicant ' s request should be approved for cause:
1) The original placement of the dwelling has created a hardship
for the applicant .
2) The hardship is unique to this property and is not generally
shared by other properties in the areaa.. L 074i7
