The applicant seeks a variance from Section 10.4 of the Albemarle
County Zoning Ordinance. This section states:
"10.4 Area and Bulk Regulations
Yards, minimum:
Front: 75 feet . . . . "
The applicant proposes to construct a new single family dwelling
and seeks a reduction of the front yard setback measurement from the
minimum requirement of seventy-five (75) feet to forty-five (45) feet .
The basis for the applicant ' s request is the limited area available
for the installation of the septic system. The applicant has submitted
a letter from Jeffrey T. McDaniel , Sanitarian for the Thomas Jefferson
Health Department . Mr. McDaniel states that the only means by which
a gravity septic system will work on this lot is if the proposed
dwelling is shifted forward on the property.
RECOMMENDATION:
Based on the findings of Mr. McDaniel , the staff recommends
approval of the applicant ' s request .

This letter is to inform you that on February 17, 1987, during
the regular meeting of the Albemarle County Board of Zoning Appeals,
your application for VA-87-7 was denied.
Anyone aggrieved by a decision of the board can appeal the
decision to the Circuit Court of Albemarle County within thirty
days of the decision.
