Buyer shall apply for loan within five (5) days after acceptance of this contract, and shall use diligence to obtain said loan, shall cooperate with the lender in order to process the application, and accept the loan if offered. The Seller agrees to convey the above property by a GENERAL WARRANTY Deed with English Covenants of Title and to pay for preparation of Deed and recordation tax applicable to Seller. Buyer agrees to pay all other recordarion costs and costs of securing financing and preparing any instruments in connection with such financing and the recording thereof. The property is to be conveyed subject to any easements and restric- tions of record which do not affect the merchantability of title. The title is to be free and clear of all liens and indebtedness of every kind except liens specifically mentioned herein. Should the title he found defective and said title cannot be made merchantable,or owners title insurance provid- ed for, within a reasonable time, this contract may be declared null and void by the Buyer and the deposit paid herein returned. Seller warrants that all appliances,electrical outlets and systems,heating and cooling systems,water and plumbing systems,and roofing systems are in working order at time of closing. Inspection to be made before closing. Notice of a defect in a warranted item must be delivered to Seller or his attorney prior to closing or occupancy or the Buyer waives his right unger such warranty. Buyer represents that an inspection satisfactory to Buyer has been made of the property and Buyer agrees to accept the property in its present condition, except as may be otherwise provided. All risk of liability and loss or damage to the property by fire, casualty or other cause is assumed by Seller until settlement. ' Possession shall be delivered on date Of settlement . If the above property contains a residence, Seller, at his expense, shall provide Buyer with a licensed exterminator's written report showing that a visual and timber sounding inspection of accessible areas of the dwelling, including understructures was made within 30 days before settlement date and that any discovered infestations of termites and/or othet wood boring insects and structural damage from that or prior infestations have been remedied. If any lender requires a well water quality or septic system inspection as a condition of making a loan, such report shall be furnished by Seller at their expense prior to closing. Buyer and Seller agree that the Realtor was the sole procuring cause of this contract of sale, and the Seller agrees to pay the Realtor a cash fee of # 6%(Six per cent) . In the event of default by either party, the defaulting party shall pay the Realtor the full commission, and shall be responsible for all damages and all expenses incurred by the non-defaulting party in the enforcement of this Contract, including, without limitation, attorneys' fees and costs. Seller directs closing attorney to pay all fees due Realtor from Seller's pro- ceeds at time of settlement and prior to disbursement of the balance of funds to Seller.
