Shifflett : This letter is to inform you that on March 10 , 1987 , during the regular meeting of the Albemarle County Board of Zoning Appeals , your application for VA-87-10 was ap- proved with the stipulation that there be no further sub- division of the lot . This variance approval allows relief from Section' 4 . 6 . 1 of the Albemarle County Zoning Ordinance to reduce the lot width from two hundred fifty (250) feet to two hundred (200) feet to allow construction of a new single- family dwelling . The plat dated September 20, 1990 by Roger W. Ray and Associates, Inc. shows the lot width at the front of the house is 198 . 03 feet. The variance was based on the best available information at the time, which did not include a surveyed line, showing a lot width of 200 feet. Shifflett TAX MAP/PARCEL: 70/26 ACREAGE : 5 . 82 acres ZONING: RA (Rural Areas) LOCATION: North side of Rt . 692 , + . 3 miles east of its intersection with Rt . 691 The applicant seeks a variance from Section 4 . 6 . 1 of the Albemarle County Zoning Ordinance . This section , pertaining to lot width , states : "4 . 6 . 1 Minimum Lot Width Measurement : Minimum lot width shall be measured at the building setback line , and shall be at least the same width as frontage required for the district in which such lot is located . (amended 3-18-81) " The lot frontage requirement for the applicant ' s property is 250 feet . The applicant seeks a reduction of the minimum lot width measurement from the required 250 feet to 200 feet to en- able construction of a new single-family dwelling. The appli- cant can relocate the dwelling in a manner to conform with the Zoning Ordinance requirements but would then incure additional construction costs in the installation of the septic system. The applicant ' s plat indicates that without the variance the dwelling will be constructed on sloping terrain. RECOMMENDATION The application should be denied for cause : 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience . 2) The applicant has not demonstrated that his perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The requirement the applicant seeks relief from is shared by all properties zoned RA. 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered .
