The variances were granted from Sections 30 . 5 . 6 . 2 . 1 , 30 . 5 . 6 . 2 . 2 , 30 . 5 . 7 . 1 , and 30 . 5 . 7 . 2 of the Albemarle County Zoning Ordinance as follows : 1 . to reduce the setback for the canopy from one hundred fifty (150) feet to one (1) foot ; 2 . to reduce the setback for off-street parking spaces from fifty (50) feet to one (1) foot ; 3 . to reduce the setback for a free-standing business sign from one hundred fifty (150) feet to one (1) foot ; 4 . to increase the height of the free-standing business sign from ten (10) feet to twenty (20) feet ; -- 5 . to increase the allowable square footage for a free-standing business sign from eighteen (18) square feet to forty (40) square feet . APPLICANT: Tiger Fuel Company TAX MAP/PARCEL: 60/25B ACREAGE: 1 . 71 acres ZONE : C-1 (Commercial) LOCATION: North side of Rt . 250 at its intersection with Canterbury Road The applicant seeks a variance from Sections 30 . 5 . 6 . 2 . 1 , 30 . 5 . 6 . 2 . 2 , 30 . 5 . 7 . 1 , and 30 . 5 . 7 . 2 of the Albemarle County Zoning Ordinance . These sections , pertaining to the Scenic Area - High- ways District , state : "30 . 5 . 6 . 2 SA-HIGHWAYS 30 . 5 . 6 . 2 . 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls , except as here- after provided in the case of certain signs , shall be con- structed within any SA-highways overlay district . 30 . 5 . 6 . 2 . 2 No off-street parking or loading shall be allowed closer than fifty (50) feet to the right-of-way line of a SA-highway which is all or part of off-street parking facil- ities required or designed to accommodate more than two (2) motor vehicles . . . . 30 . 5 . 7 SIGN REGULATIONS , SA-HIGHWAYS 30 . 5 . 7 . 1 GENERAL REGULATIONS The location, configuration, design, materials and color of all signs and strucures shall be encouraged to be in character with the historical and environmental setting of Albemarle County. No sign shall visually dominate the structure to which it is attached and shall be architecturally harmonious with the surrounding structures . Sign materials should be predominantly wood or utilize open lettering, and indirect lighting shall be encouraged . . . . 30 . 5 . 7 . 2 REGULATION OF NUMBER, HEIGHT, AREA, TYPES OF SIGNS The following regulations shall be in addition to section 4 . 15 . 3 generally and shall be further limitation on regula- tions contained in sections 4 . 15 . 3 . 6 and 4 . 15 . 3 . 7 , specifically: b. Freestanding business and projecting business signs shall be limited to ten (10) feet in height above grade , eighteen square feet per single sign face , and to one (1) sign per separate highway frontage . " Page 2 Staff Report - VA-87-11 Tiger Fuel Company "The depth of the SA-HIGHWAYS Overlay District is established in Section 30 . 5 . 2 . 2 which states : "30 . 5 . 2 . 2 SA-HIGHWAYS SA-HIGHWAY Overlay Districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way: a . U. S . Route 250 from the western corporate limits of the City of Charlottesville to the western Albemarle County border . " The applicant at present operates a non-conforming automobile service station on the property. The applicant proposes to retain the gasoline sales area and to change the automobile repair area into a food store . In performing the renovations , the applicant proposes to replace the existing free-standing business sign, con- struct a canopy to cover the gasoline dispensing area and add off- street parking spaces for the food store . The specific variances the applicant seeks are : 1) to reduce the setback for the canopy from one hundred fifty (150) feet to one (1) foot ; 2) to reduce the setback for off-street parking spaces from fifty (50) feet to one (1) foot ; 3) to reduce the setback for a free-standing business sign from one hundred fifty (150) feet to one (1) foot ; 4) to increase the height of the free-standing business sign from ten (10) feet to twenty (20) feet ; 5) to increase the allowable square footage for a free-standing business sign from eighteen (18) square feet to forty (40) square feet . A nonconforming, free-standing business sign exists on the property. This sign could be utilized by the applicant as long as the sign area is not increased . RECOMMENDATION The applicant ' s requests should be denied for cause : 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would pro- duce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience . f 0 Page 3 Staff Report - VA-87-11 Tiger Fuel Company 2) The applicant has not demonstrated that the perceived hard- ship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. Tax Map 60 , Parcel 25A and 25B DATE: February 10:, 1987 Please be advised that I have reviewed the above referenced plan and have the following comments : (1) Parking is calculated for all uses on Tax Map 60 , Parcel 25B, except for the existing paint shed. Is this shed used for storage, or in connection with the service station? We need to determine this to see if additional parking will be required. (2) The gross floor area is listed as 16 ,147 square feet. The floor area is broken down as follows : 9 , 334 square feet retail 2 , 300 square feet office 2 , 812 square feet miscellaneous "oCej,\/<). 14 , 446 < ' The total of 14 , 446 square feet leaves a balance of � 4--i 1 ,701 square feet which is not accounted for. `� �c1 We will need to know what the 1,701 square feet is q ' / used for, before we can approve this plan. ?
