On Tuesday, February 24 we received an opinion from the Assistant Zoning Administrator which makes a variance unnecessary and resolves the set-back issue. The Zoning Administrator' s office has researched riginthe oldy zoning records and discovered thaordinanPproperty e was adopted. This ws oal zoned R-2 at the time the zoning and set back. Under the zoning required only a 30 - foot front yinance terms of the non-conforming us32sections feet fromftheenewdpropertyhline existing house (which is someneed be set back following dedication of the public highway) rneedar onlyynbeosetrback ming 30 feet. Thus, rather than simply use, this particular house can be improved, added on to, and the like without the necessity of any variance. The only situation under which a problem could ever arise wouldsbe ifrthene . lfouse were voluntarily and deliberately destroyed by destruction were involuntary (fire, casualty, etc. ) then it could be rebuilt in its present location.
