Key Estate Tax Map 45 , Parcel 76 Variance Application Dear Andy: Enclosed with this letter is a variance application and our check in the amount of $50 for the application fee. The requested variance is for the property captioned above. The purpose of this letter is to expand upon the justification paragraph in the variance application. This property contains a masonry two story house built approximately forty years ago. It is basically a good, solid structure but it has seen a good deal of neglect in recent years . We intend to clean up and rehabilitate it. Of particular concern is the plumbing. It appears the house was originally constructed without plumbing and plumbing was added later. The only sanitary service on the first or main floor of the house is a toilet and sink standing open and unpartitioned in the middle of the master bedroom. The only proper way to straighten out the plumbing problem and to modernize the structure is to add a small addition to the rear of the building (away from the state road) . An entirely new plumbing system would be placed in this new addition and the old plumbing would be removed from the existing structure. Adding a wing to the rear of the existing structure would, I understand, create a violation of Section 10 . 4 of the zoning ordinance. The new addition would of necessity have to be built inside the 75 foot building set-back line. In order to permit the construction of this addition and perhaps a porch or other improvements to the property it will be necessary to obtain a variance from the ordinance ' s 75 foot front yard set-back. The front wall of the existing structure is located approximately 32 feet from the property line. We are requesting a variance of 43 feet to allow a minimum 32 foot set-back. This will assure that any additions to the structure are located no closer to the road than the existing house. #2 TOWN HALL SQUARE, POST OFFICE BOX 1465,CHARLOTTESVILLE,VIRGINIA 22902 (804) 971-8080 �- 04110 We believe that a variance is justified because at the time of the effective date of the zoning ordinance this house already existed. It is a non-conforming use due to the later creation of the ordinance. A strict application of the set-back requirements would effectively prohibit or unreasonably restrict anyone ' s ability to install modern plumbing in the existing house. This would result in the house and the property being greatly reduced in value. This, in turn, would create a severe hardship for the estate of the former owner. This property is the subject of a partition proceeding in the Circuit Court of Albemarle County under which the heirs of John H. Key are attempting to have the property sold and the proceeds divided. In order for the heirs to realize the Court' s appraised value it is necessary that the house be given substantial prospective value. This is only possible if it can, in fact, be improved and modernized. We believe that the existing situation is a hardship through no fault or action of theirs. The hardship was created by the imposition of the zoning ordinance after the building was already constructed. This hardship is peculiar to this particular piece of land and this particular house. Because any additions to the existing structure will take place at least as far or further from the road than the existing structure already stands there will be no detriment to adjacent property owners. There should be no change in the character of the district as a result of the requested variance.
