Dear Mr . Martin:
This letter is to inform you that on April 14 , 1987 ,
during the regular meeting of the Albemarle County Board
of Zoning Appeals , your application for VA-87-14 was ap-
proved .
This variance approval allows relief from Section
10 .4 of the Albemarle County Zoning Ordinance to reduce
the minimum lot size from 2 . 0 acres to 1 . 8 + acres and
to reduce the minimum lot frontage from 250 feet to 139
feet to allow subdivision of the property.

ZONING : RA (Rural Areas)
ACREAGE : 3 . 63 acres
LOCATION: East side of Route 729 , + . 3 miles south of
its intersection with Route 732
The applicant seeks a variance from Section 10 .4 of the
Albemarle County Zoning Ordinance . This section states :
"10 .4 Area and Bulk Requirements
Minimum lot size 2 .0 acres
Minimum frontage existing
public roads 250 feet . . . . "
The applicants propose to subdivide their property and seek
a reduction of the lot area for each new parcel from the minimum
requirement of 2 .0 acres to + 1 . 8 acres and to reduce the lot
frontage from the minimum requirement of 250 feet for each new
parcel to 139 feet . Two dwellings presently exist on the pro-
perty. Mr . Curry resides in the dwelling on the northerly side
of the property. The other dwelling is known as the Johnson-
Milton House .
The variance is being sought so as to allow subdivision of
the property. Ms . Johnson and Mr . Curry were each deeded one-
half of the property. Ms . Johnson was deeded the southern one-
half of the property in a deed dated October 30 , 1972 . Mr . Curry
was deeded the northern one-half of the property in a deed dated
September 11 , 1974 . The applicants now desire to physically divide
the property into two separate parcels but are unable to do so.
The applicant ' s believe the subdivision is necessary to assure a
smooth transition of the properties to future generations .
RECOMMENDATION
In that the two (2) dwelling structures exist and the division
line can be established in such a manner to provide for adequate
side yard setback , the staff recommends approval of the applicants '
requests .
