Dear Ladies and Gentlemen:
This letter is to notify you, as adjoining property owners,
that Roy Lee Yancey property described as Tax
Map 46A2, Parcel (s) 01-5 , Zoned R-2 , has made
application for VA-87-17 , requesting relief from
Section (s) 14. 3 of the Albemarle County
Zoning Ordinance, as follows:
The applicant seeks a variance from section 14. 3 of the Albemarle
County Zoning Ordinance to reduce the side setback measurement
from the required 10 feet to 3 feet to allow construction of an
• attached garage.
A public hearing will be held by the Board of Zoning Appeals
on - April 14 10:187 , at 3:00 p.m. , in Meeting Room #7, Second
Floor, County'Office Building, 401 McIntire Road, Charlottesville,
Virginia.

Dear Mr. Burgess:
Thank you so very much for the time you spent with me last
week explaining exactly what my neighbor, Roy Yancey, has
requested by seeking a variance from Section 14.3 of the
Albemarle County Zoning Ordinance.
I do not know what all of my rights are as an adjoining
property owner other than that the law states he cannot build
within the required 10 ft. of my property line, and I request
that the Board honor this.
I have submitted to you a copy of my plot plan, which as you
can see, is more or less a pie shape. There are already 3 sheds
abutting my property in a very small area of my back yard; one
belongs to Mr. Yancey (and I believe that it is closer to my line
than it should be) ; one is to the rear of my property approximately
20 ft. from my deck and is considerably larger than most and
placed broad side; and another to the right of my property by the
Kyles. All views are restricted to sheds with the exception of
an angle to the left, which is where Mr. Yancey wishes to erect a
garage. This will then create the fourth building and will
encroach upon my land by 7 ft. I might add that I have no
storage shed and have refrained from erecting one because I
thought the property would look like I was selling storage sheds.
Can you imagine all of these buildings within a small
circumference of land?
Raintree, thus far, with the exception of my property, is
quite pretty, which is why I purchased my home. The area has
grown in value and is in demand. My home, however , is less
desirable and has not grown in value with my neighbors because of
the buildings mentioned above. This variance would add to the
problem which already exists. I have contacted a real estate
agent who has confirmed these facts and who will either appear
before you or write a letter to that effect.
When I originally moved to Raintree my intentions were to
have good relationships with my neighbors as I had previously in
Hollymead and so when I felt that Mr. Yancey's shed was too close
to my property, I mentioned it to him, but he said it was erected
by a previous owner. I did nothing further as I didn't feel I
wanted to cause a problem over it. However, one day I came home
for lunch when Mr. Wayne Nuckols was building his with his father
and was caught by surprise to see how close he was putting it. I
spoke to him about it, he called the Zoning Office (I believe) ,
and moved it over a few feet. Since then he stores bags of
fertilizer and his trash dumpster on my side so that I can look
at it from my patio door and deck. He also has a garage.
It is quite apparent that my neighbors are trying to
increase the value of their property while mine is decreasing.
I hope that we can find an amicable solution to this ever
increasing problem.
If I can assist you with any other information to aid you in
your decision, please let me know. This has been a cause of
great concern to me and I look to you for whatever relieif is in
your power.

P. S. It would be interesting to know if all of these buildings
received permits , are the correct amount of footage from
property lines , and if they were approved by the Architectural
Review Committee of Raintree.

I have carefully reviewed the property at 1515 Shadow Oaks
place , Raintree Subdivision, for Ms . Ceil Steiner and it is
my .opirion ;.that any variances awarded to the adjoining property
owners due to the size of the lots would block the views , fur-
ther conjest her area and possibly affect the value and
saleability of her property that already has three storage
sheds to the rear of her backyard.
