Dear Mr. Melton:
This letter is to inform you that on May 12 , 1987 , during the
regular meeting of the Albemarle County Board of Zoning Appeals ,
your application for VA-87-28 was approved.
This variance approval allows relief from Section 4.15. 3 . 7 of
the Albemarle County Zoning Ordinance to allow an increase in the
allowable square footage of wall signs from 200 square feet to
350 square feet , subject to the following conditions:
(1) 50 square feet total on Building "A"
(2) 350 square feet total on Building "B"
• (3) Subject to being in conformity with this project
and adjoining parcels under the direction of the
Zoning Administrator.

STAFF REPORT - VA-87-28
APPLICANT: Village Offices Limited Partnership
TAX MAP/PARCEL: 61U/2 , 3 , 4
ZONING: H-C (Highway Commercial)
The applicant seeks a variance from Section 4.15. 3 .7 of the
Albemarle County Zoning Ordinance. This section states:
. . . Business sign, wall : (b) the aggregate area of
all such signs shall not exceed two hundred (200) square
feet . "
The applicant has two (2) buildings located on a three (3) lot
. development site. Building '-'A" will have one (1) tenant , and
Building "B" is partitioned to accommodate eight (8) tenants. The
applicant proposes to allot 50 square feet of signageto Building "A" ,
and 350 square feet to Building "B" , thus requiring a 150 increase
over the allowed 200 square feet .
The application should be denied for cause:
1) The applicant has not provided evidence that a strict
application of the ordinance would produce a clearly
demonstrable hardship approaching confiscation as
distinguished from a special privilege or convenience.
2) The applicant has not demonstrated that the perceived
hardship is unique to his property in contradistinction
to other properties in the same zoning district and
general vicinity. All properties in the H-C Commercial
zone share the same requirements.
3) The applicant has not demonstrated that the authorization
of the variance will not be of substantial detriment to
the adjacent properties or that the character of the
district will be altered.
In the event the Board should find just cause to grant the
applicant ' s request the staff would suggest the following conditions.
(a) That the allotted signage be controlled as per the
applicant ' s statement : Building "A" - 50 square feet total
Building "B" - 350 square feet total
b) That no free-standing signs be allowed
