of its intersection with Rt . 644, zoned RA. The applicant seeks
a variance from Section 10 .4 of the Albemarle County Zoning
Ordinance to reduce the side yard from the required twenty-five

Regarding: VA-87-29
Dear Mr. Burgess:
Jaeger& Ernst request that a zoning variance be granted on the setback
requirements for an addition to the existing building for the following
reasons:
1. Because of the "exceptional narrowness, size (and) shape" of our
property, there is no alternative way to provide reasonable expansion
of the existing building which was acquired with that property.
Disallowing this variance would cause undue hardship by placing
the addition at an unworkable distance from the building now in use.
2. Our property adjoins the Southern Railway where, at one time, the
railroad operated a spur line accessing the existing building. About
ten years ago the railroad removed the spur. Consequently, the distance
from the main tracks normally allowed by the railroad is at least twice the
usual distance. The proposed addition would in no way restrict or impede
access by the rail company to or from their property.
3. The opposite boundary, containing the right of way held by Mr. Damon,
would suffer no restrictive consequences from the proposed addition.
In conclusion, I submit that granting the setback variance on the
proposed addition would " be of no substantial detriment to adjacent
property and that the character of the district will not be changed by
the granting of the variance."
