Stoddard : This letter is to inform you that on June 9 , 1987 , during the regular meeting of the Albemarle County Board of Zoning Appeals , your application for VA-87-33 was approved with the following conditions : 1) no other signs be allowed on the premises 2) that this be reviewed by board in 3 years 3) sign not exceed 4 feet in height 4) sign be of wood or masonery construction 5) sign not be of any reflective material , and not be illuminated This variance approval allows relief from Section 4 . 15 . 3 . 5 of the Albemarle County Zoning Ordinance to increase the allow- able sign area for an identification sign from two (2) square feet to eight (8) square feet . Burgess Zoning Administrator CWB/st cc : VA-87-33 S-87-37 STAFF REPORT - VA-87-33 APPLICANT: Four Seasons Condominiums Association TAX MAP/PARCEL: 61X1/3A 1-48 ZONING : Planned Unit Development (PUD) LOCATION: West side of Four Seasons Drive at its intersection with Spring Court The applicant seeks a variance from Section 4 . 15 . 3 . 5 of the Albemarle County Zoning Ordinance . This section states : "4 . 15 Signs 4 . 15 . 3 . 5 Residential (R-10 and R-15) ; Planned Residential Development (PRD) ; Planned Unit Development (PUD) Identification Signs : Provided (a) not more than two (2) square feet in area . . . . The applicant seeks a variance to enable the enlargement of an identification sign from the maximum allowable area of two (2) square feet to eight (8) square feet . The applicant indicates that the sign would be of wood construction and would measure a total of four (4) feet in height . The applicant proposes to place the sign twenty (20) feet west of the Four Seasons Drive right-of- way . RECOMMENDATION The application should be denied for cause : 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a demonstrable hardship approaching con- fiscation as distinguished from a special privilege or convenience . 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity . 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered . In the event the Board of Zoning Appeals finds cause to approve the applicant ' s request , the following conditions should be considered : 1) that the sign not exceed a height of four (4) feet 2) that the sign be wood and/or masonry construction and shall not consist of any reflective materials 3) that the sign not be illuminated .
