Box 3414 Charlottesville , Virginia 22903 Re: Board of Zoning Appeals Action VA-87-36, Tax Map 60, Parcel 37 Dear Mr. & Mrs. 4eague: This letter is to inform you that on June 9, 1987 , during the regular meeting of the Albemarle County. Board of Zoning Appeals , your application for VA-87-36 was approved subject to the following conditions: 1) Should road improvements be made that would cause any need to relocate the sign that the property owner incur all expenses. 2) Sign drawing as submitted be approved with variance application. This variance approval allows relief from Sections 30 . 5 .6.2. 1 and 30. 5.7.2(b) of the Albemarle County Zoning Ordinance to reduce the front set-back in the Scenic Highway Overlay District from one hundred fifty (150) feet to one (1) foot and to increase the allowable sign area for a free-standing business sign from eighteen (18) square feet to twenty-four (24) square feet to allow construction of a new free-standing business sign. Burgess Zoning Administrator CWB/mlm cc: VA-87-36 Inspections 0 STAFF REPORT - VA-87-36 APPLICANT: Joseph W. or Mary Jane Teague TAX MAP/PARCEL : 60/37 ACREAGE : . 90 ZONING: HC (Highway Commercial) LOCATION: South side of Rt . 250 west , approximately 1/10 of a mile west of its intersection with Colonnade Drive The applicant seeks relief from Sections 30 . 5 . 6 . 2 . 1 and 30 . 5 . 7 . 2 . Included is Section 30 . 5 . 2 . 2 which establishes the Scenic Overlay District . The following sections state : 30 . 5 . 2 . 2 SA - Highways SA- (Scenic Areas) Highways Overlay Districts are hereby established along the following highway corridors in Albemarle County for a distance of one-hundred fifty (150) feet on each side of the right-of-way . a) U. S . Route 250 from the western corporate limits of the City of Charlottesville to the western Albemarle County border . 30 . 5 . 6 . 2 . 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls , except as hereafter provided in the case of certain signs , shall be constructed with- in any SA - Highways Overlay District . 30 . 5 . 7 . 2 (b) Free-standing business and projecting business signs shall be limited to ten (10) feet in height above grade , eighteen (18) square feet per single sign face , and to one (1) sign per separate highway frontage . The applicant wishes to erect a free-standing business sign twenty-four (24) square feet in aggregate area , requiring a vari- ance of six (6) square feet . The business sign will be located one (1) foot from the highway right-of-way, thus requiring a one- hundred forty-nine (149) foot variance . An existing business sign for the funeral home is located fourteen (14) feet from the road right-of-way. New site construc- tion which will establish a curb island causes the need to re- locate the sign . A new sign is proposed which incorporates a rock base and pillow as support . The applicant ' s approved site plan indicated the location of the existing sign, proposed new sign, and a temporary one . Page 2 Staff Report - VA-87-36 Joseph W. Teague IMPORTANT INFORMATION The County Comprehensive Plan, Chapter 13 - Transportation Plan includes committed projects and additional ones that are recommended to be developed in Phases I thru IV. Recommenda- tions under Phase II Category is Ivy Road (Route 250 Business) between Emmet Street and Route 29/250 Bypass - widen to 4-lanes with flush median . Note : Copy of approved site plan shows pro- posed future road right-of-way to include sign location . RECOMMENDATION The applicant ' s request should be denied for cause : 1) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience . 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The requirements the applicant seeks relief from are shared uniformly by all properties located in a SA - Highways Overlay District . 3) The applicant has not provided evidence that the authori- zation of the variance will not be of substantial detri- ment to the adjacent properties or that the character of the district will be altered . Should the Board wish to grant the applicant ' s request , the staff makes the following recommendations as a condition : 1) Should road improvements be made that would cause any need to relocate the sign that the property owner incur all expenses . 2) Sign drawing as submitted be approved with variance appli- cation . 4 i
