HALL, JACK JOUETT SECTION 30 N4 '44 ' '444 AND CHARLOTTESVILLE DISTRICTS June 3, 1987 Mr. Andrew Evans Deputy Zoning Administrator Department of Zoning 401 McIntire Road Charlottesville, VA 22901 Dear Mr. Evans: I recently received a notice concerning a scheduled variance hearing for File No. VA-87-37. This application apparently is asking for relief from section 4.6.3.2 of the Albemarle County Ordinance to reduce a side yard setback from 60 to 48.6 ft. I own lot no. 12 (28C) in the Blue Ridge Subdivision. This subdivision area is less than 5 yrs. old and to my knowledge this is the second variance request in that short time. My concern is that these types of problems will continue. The owners of Soltec, Inc. live in this subdivision and they own all of the remaining empty lots, as well as being the exclusive builder for the area. The ordinance in question should not be a mystery to Soltec and it' s owners , nor should the ordinance be continually abused. I would like to record my objection to allowing this variance. All of the other homes in the area are set back well beyond the 60 ft. offset line except this parcel , 28J. It sticks out like a sore thumb and I believe that there is no excuse why the ordinance of 60 ft. was not adhered to. What sense is there to making rules if they are continually broken? I would like the zoning board to ask the owners of Soltec, Inc. ; Michael Cernik, John Stoner, and David tdhentley if they are breaking the rules simply because they live in Blue Ridge Forest and earn part of their livelyhood there as well .
