This variance approval allows relief from Section 10.4 of the Albemarle County Zoning Ordinance to reduce the minimum lot size from 2.0 acres to 1.9 acres to allow subdivision of the property. Campbell TAX MAP/PARCEL: 29/6 ACREAGE: 3 .855 ZONING: RA (Rural Areas) LOCATION: West side of Route 665, + .5 miles south of its intersection with Route 609 The applicant seeks a variance from Section 10. 4 of the Albemarle County Zoning Ordinance. This section states: "10.4 Area and Bulk Regulations Minimum lot size 2.0 acres . . . " The applicant at present has a triangular shaped parcel containing 3.855 acres. The applicant proposes to subdivide the property and seeks a variance to reduce the minimum lot size for the two (2) new lots from the minimum requirement of two (2) acres to approximately one and nine-tenths (1.9) acres each. One dwelling presently exists on the south side of the property. The applicant states that the property was purchased in 1985 and contained 4.1 acres. A twenty (20) foot right-of-way dedication to the Virginia Department of Highways and Transportation reduced the property to the present size of 3 .855 acres. The applicant has contacted the adjacent property owners but has been unable to pur- chase additional property. RECOMMENDATION The applicant ' s hardship is a direct result of the twenty (20) foot dedication to the Virginia Department of Highways and Trans- portation . Unfortunately, the staff does not believe this is sufficient cause to recommend favorably on the applicant ' s request . The application should be denied for cause: 1 ) The applicant has not provided sufficient evidence to show that a strict application of the Zoning Ordinance would produce a demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience. 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. Campbell 3) The applicant has not provided evidence to demonstrate that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered.
