Clark TAX MAP/PARCEL: 126/33D ACREAGE: 1 . 30 ZONING: RA (Rural Areas) LOCATION: North side of Route 6 , + . 1 mile east of its intersection with Route 800 The applicant seeks a variance from Section 30. 5 .6.2. 1 of the Albemarle County Zoning Ordinance. This section states: "30 . 5.6 .2 SA - Highways 30 .5.6 .2.1 No buildings or structures other than necessary appurtenant fences and/or walls , except as hereafter provided in the case of certain signs, shall be constructed within any SA - highways overlay district . " The scenic highway overlay district designation and setback dimension is established in Section 30 . 5 .2 .2 , which states: "30. 5.2 .2 SA - Highways SA - highway overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way: c) Virginia Route 6 from the corporate limits of the Town of Scottsville westward through several dis- continuous portions of Albemarle County. " The applicant at present operates a country store at this location and has gasoline dispensing facilities as an accessory use . The applicant had a nonconforming gasoline pump island and canopy which was voluntarily removed and replaced with a larger pump island and a larger canopy. The nonconforming pump island and/or canopy was located approximately ten (10) feet from the Route 6 right-of-way. The new pump island and/or canopy is located approximately twenty-five (25) feet from the Route 6 right-of-way . The applicant did not obtain a building permit for the construction of the canopy. The applicant now seeks a variance of the SA - Highways setback from one hundred fifty (150) feet to twenty-five (25) feet . w.w `w✓ Page 2 Staff Report - VA-87-42 Eula K. Clark RECOMMENDATION The application should be approved for cause : The designation of the SA Highway Overlay District has created a hardship for the applicant in that the SA District measures one hundred fifty (150) feet from the right-of-way , and the applicant ' s property is only one hundred fifty-five (155) feet deep at its deepest point . The granting of the variance will not adversely effect the adjacent properties nor will the character of the district be substantially altered.
