LOCATION: Southwest corner of State Route 250 West and
State Route 639
The applicant requests a variance from Section 30. 5.6.2. 1 of
the Albemarle County Zoning Ordinance. The following section
states:
"30 .5.6 .2 SA - Highways
30. 5.6.2 . 1 No buildings or structures other than necessary
accessory appurtenant fences and/or walls, except as here-
after provided in the case of certain signs , shall be con-
structed within any SA - Highways Overlay District . "
"30. 5.2 .2 SA - Highways
SA (Scenic Areas) Highways Overlay Districts are hereby
established along the following highway corridors in
Albemarle County for a distance of one hundred fifty
(150) feet on each side of the right-of-way.
a) U. S. Route 250 from the western corporate limits of
the City of Charlottesville to the western Albemarle
County border"
The applicant proposes to construct a covered porch to encompass
both entry into the store and post office. Each entry has an indi-
vidual roof covering existing. A handicapped ramp is proposed to
serve the new entry access.
The staff is compassionate to the applicant ' s proposal but
does not find justification for recommending approval .
RECOMMENDATION
The request should be denied for cause:
1 ) The applicant has not demonstrated that the perceived
hardship is unique to his property in contradistinction
to other properties in the same zoning district and
general vicinity. The requirements the applicant seeks
relief from are shared uniformly by all properties
located in a SA - Highways Overlay District .

2) The applicant has not provided sufficient evidence to
show that a strict application of the Zoning Ordinance
would produce a clearly demonstrable hardship approaching
confiscation as distinguished from a special privilege
or convenience .
3) The applicant has not provided evidence that the authori-
zation of the variance will not be of substantial detriment
to the adjacent properties or that the character of the
district will be altered.
Should the Board wish to grant the applicant ' s request , the
staff makes the following recommendations as conditions:
1 ) That the proposed construction not disrupt the existing
parking area, and if such does occur that the Planning
staff review and approve any change in parking.
2) That the finish state of the facade of the new construction
be of compatable material and natural colors to blend in
harmoniously with the scenic highway character . This
recommendation is made because a drawing was not submitted
with the application.
