Noe STAFF REPORT: VA-87-47 OWNER: Exxon Company, USA TAX MAP/PARCEL: 61W/02-C2 ZONING: C-1 (Commercial ) LOCATION: Northeast corner of Rt 29 and Westfield Road The applicant seeks a variance from Sections 4 . 15. 3 .6 and 21 .7. 1 of the Albemarle County Zoning Ordinance . These sections, pertaining to the size and location of signs, state: "4. 15 Signs 4.15 . 3 .6 Commercial (C-1) and Commercial Office (CO) • •Business signs, Free-standing or Projecting: Provided: (a) if illuminated , no moving flashing, blinking, color- changing or exposed , bare or uncovered neon illumination or lighting; (b) the aggregate area of such signs shall not exceed fifty (50) square feet . . . 21. 7 Minimum yard requirements 21 . 7. 1 Adjacent to public streets: No portion of any structure except signs advertising sale or rental of the property shall be erected closer than thirty (30) feet to any public street right-of-way . . . " The applicant proposes to erect a new free standing business sign and seeks a variance to increase the allowable size of the new sign from fifty (50) square feet to seventy (70) square feet and to reduce the required setback from the Route 29 right-of-way from thirty (30) feet to one (1 ) foot . The proposed sign has an overall height of twenty (20) feet . At present the applicant has a total of three (3) free-standing business signs on the property with an aggregate sign area of two hundred sixty-eight (268) square feet . The existing signs are non-conforming and the applicant proposes to remove all three (3) signs if the variance request before the Board of Zoning Appeals is approved. The proposed sign would be located on the south west corner of the property in the general vicinity of one of the existing free-standing signs. Recommendation The applicant has not demonstrated the existence of a hardship or the potential effects of the variance on the C-1 (Commercial ) District .
