LOCATION: West side of Rt 785, ± .3 miles north of its
intersection with Rt . 649
The applicant seeks a variance from Section 10. 4 of the Albemarle
County Zoning Ordinance. This section states:
"10 . 4 Area and Bulk Regulations
Minimum Lot size 2 .0 Acres . . . "
The applicant proposes to subdivide his property and seeks
a variance to reduce the minimum lot size from 2 .0 acres to 1 .97
acres for one of the new parcels. The other new parcel will have
a lot size of 2 .0 acres. A dwelling presently exists on the
southerly half of the property. The applicant has been unable to
obtain .03 acres (1304 square feet ) from an adjacent property owner
to alleviate the need for a variance.
RECOMMENDATION:
The staff recognizes that the applicant ' s request is a minor
variation of the minimum lot area required in the Rural Areas.
Unfortunately , there is no basis for the staff to make a favorable
recommendation.
The application should be denied for cause:
1) The applicant has not demonstrated that a hardship
exists which is unique to this property in
contradistinction to other properties in the same
zoning district and general vicinity.
2) The applicant has not provided any evidence to
demonstrate that a strict application of the Zoning
Ordinance would produce a clearly demonstrable hardship
approaching confiscation as distinguished from a special
privilege or convenience .
3 ) The applicant has not provided evidence to demonstrate
that the authorization of this variance will not be of
substantial detriment to the adjacent properties or
that the character of the district will not be altered.
