A\\A Q-1- f_ . &1..1A— to,..,e4 ia �Y-LLJLX. err STAFF REPORT - VA-87-49 APPLICANT: Bell Atlantic Company TAX MAP/PARCEL: 127/40A ZONING: RA (Rural Areas) LOCATION: North side of Rt 6 , ± .1 mile east of its intersection with Rt 722 The applicant seeks a variance from Section 30. 5.6 .2. 1 of the Albemarle County Zoning Ordinance . This section , pertaining to the location of structures in the Scenic Highway Overlay District , states: "30.5.6 .2 SA- Highways 30 .5.6. 2. 1 No buildings or structures other than necessary appurtenant fences and/or walls, except as hereafter provided in the case of certain signs , shall be constructed within any SA - highways overlay district . " The scenic highway overlay district designation and setback dimension is established in Section 30. 5.2 .2 , which states: "30. 5. 2. 2 SA - Highways SA - highway overlay districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way: c) Virginia Route 6 from the corporate limits of the Town of Scottsville westward through several dis- continuous portions of Albemarle County. " The applicant has located a structure on the property and seeks a reduction of the setback from the Route 6 right-of-way from the minimum requirement of one hundred fifty (150) feet to thirty- three (33 ) feet . The structure is used as a regeneration location for the fiber optic cable network. The structure will be unmanned. The applicant has not demonstrated that a hardship exists which would justify the granting of the requested variance . However , the staff is of the opinion that the Board of Zoning Appeals should act favorably on the applicant ' s request . The reasoning for this stance is due primarily to the nature of the use. The applicant ' s predicament has been caused by the terminology used in the SA- Highways Overlay District . Specifically, the pertinent section stated earlier in this report alludes to no building or structure being located within the SA-Highways Overlay District . A structure STAFF REPORT - VA-87-49 is defined in Section 2.0 as: "Anything constructed or erected, the use of which requires permanent location on the ground, or attachment to something having a permanent location on the ground. This includes, among other things , dwellings, buildings, signs, etc. " RECOMMENDATION The staff recommends that the variance be granted with the stipulation that the perimeter of the structure be landscaped so as to screen it from the view of motorists on Route 6 . Any landscaping shall receive prior approval of the Zoning Administrator . July 22, 1987 I, Joseph E. Brochu, grant Designated Agent status to Irving L. To establish a Regeneration Location for Fiber Optic Cable Network being constructed throughout the State of Virginia. 2. Other Counties along this Fiber Cable Route have not required C&P Telephone Company to obtain a Variance for equipment location. 3. C&P Telephone Company obtained private right of way to place the Hut in question. 4. This location was approved by the Virginia Department of Highways and Transportation and meets their safety standards. 5. In order to meet acceptable transmission qualities these Huts are re- quired approximately 19 miles apart. The location in question meets this requirement. 6. Location chosen provides easy and safe access to the Hut for maintenance purposes and also provides minimum protection from vandalism. 7. Commercial electric power is readily available at this site. 8. Location provides minimum site preparation cost. As of this date the cost of the Hut and site preparation is approximately $35,000.
