I I +t1'(61 1 `�� � �,rt-5,-�e ram% c�` ('. t ( },, V k STAFF REPORT - VA-87-51 APPLICANT: Albemarle Bank and Trust TAX MAP/PARCEL: 60/40B1 and B2 ZONING: HC (Highway Commercial ) LOCATION: 2208 Ivy Road The applicant seeks a variance from Sections 30. 5.6 .2 . 1 and 30. 5.7. 2 (b) of the Albemarle County Zoning Ordinance . These sections, pertaining to the location , size and height of signs located in the Scenic Areas - Highway Overlay District , states: "30. 5.6 .2 SA - Highways 30. 5.6.2. 1 No buildings or structures other than necessary accessory appurtenant fences and/or walls, except as here- after provided in the case of certain signs , shall be con- structed within any SA - Highway Overlay District . . . 30. 5.7.2 Regulation of number, height , area, types of signs The following regulations shall be in addition to Section 4. 15. 3 generally and shall be further limitation on regulations contained in Sections 4. 15. 3 .6 and 4. 15. 3 . 7, specifically: . . . b. Free-standing business and project- ing business signs shall be limited to ten (10) feet in height above grade , eighteen (18) square feet per single sign face , and to one sign per separate highway frontage . . . " The SA-Highways District is established and the specific setback required is stated in Section 30. 5.2. 2 which states: "30.5.2.2 SA - Highways SA (Scenic Areas) Highways Overlay Districts are hereby established along the following highway corridors in Albemarle County for a distance of one hundred fifty (150) feet on each side of the right-of-way . a) U.S. Route 250 from the western corporate limits of the City of Charlottesville to the western Albemarle County border" The applicant proposes to erect a free-standing business sign and requests the following variances: 1 ) to reduce the required setback from one hundred fifty (150) feet to one (1) foot , 2) to increase the height of the sign from ten (10) feet to seventeen (17) feet , and 3) to increase the allowable sign area from eighteen (18) / square feet to seventy-two (72) square feet ' The Board of Zoning Appeals granted a variance (VA-86-41) on STAFF REPORT - VA-871 Albemarle Bank and Trust Page 2 November 11 , 1986, which allowed a reduction of the setback for a free- standing business sign from one hundred fifty (150) feet to seventy-six (76) feet as well as a reduction of the required building and parking lot setback. The staff has reviewed the applicant ' s plans and is of the opinion that the sign could be reduced without severely hindering the business identification. Specifically, the staff believes the changeable letter section of the sign as well as the logo (apple shape) could be deleted without creating a substantial detriment to the business identification. These deletions result in a sign containing an area of approximately thirty-three (33) square feet . In addition, the staff believes the sign should comply with the ten (10) foot height limitation. The applicant should also be aware that the SA-Highways District also states that "sign materials should be predominately wood or utilize open lettering, and indirect lighting shall be encouraged, " in Section 30 .5 .7.1 . The actual design , lighting and materials used in the sign are reviewed by the Director of Planning. Should the applicant be aggrieved by the decision of the Director of Planning an appeal of that determination can be made to the Planning Commission . This procedure is outlined in Section 30. 5. 7. 1(c) of the Zoning Ordinance . RECOMMENDATION The application should be denied for cause: 1 ) The applicant has not provided evidence to show that a strict application of the Zoning Ordinance would produce a clearly demonstrable hardship approaching confiscation as distinguished from a special privilege or convenience . 2) The applicant has not demonstrated that the perceived hardship is unique to his property in contradistinction to other properties in the same zoning district and general vicinity. The requirement the applicant seeks relief from are shared by all properties in the SA-Highways Overlay District . 3 ) The applicant has not shown that the authorization of the variance will not be of substantial detriment to the adjacent properties or that the character of the district will not be altered.
