LOCATION: East side of Rt 29 at its intersection with
Berkmar Drive
The applicant seeks a variance from Sections 4. 15. 3 .6 and 21 . 7. 1
of the Albemarle County Zoning Ordinance. These sections, pertaining
to the size and location of signs state:
"4.15 Signs
4.15. 3 .6 Commercial (C-1) and Commercial Office (CO)
business signs , free-standing or projecting: Provided:
(a) if illuminated, no moving, flashing, blinking,
color changing or exposed, bare or uncovered neon
illumination or lighting; (b) the aggregate area of
such signs shall not exceed fifty (50) square feet ; . . .
Business signs, wall : Provided: (a) if illuminated,
no moving, flashing, blinking, color changing or
exposed, bare or uncovered neon illumination or lighting;
(b) the aggregate area of all such signs shall not exceed
one hundred (100) square feet ; . . .
21 .7 Minimum yard requirements
1 21 . 7. 1 Adjacent to public streets: No portion of any
structure except signs advertising sale or rental of the
property shall be erected closer than thirty (30) feet to any
public street right-of-way . . . . "
The applicant proposes to replace the existing signs on the property
due to a business name change . This office does not have any records
which indicate the amount of signage presently existing on the
property. The specific variances the applicant is requesting are:
1) to increase the allowable area of a free-standing
business sign from fifty (50) square feet to seventy-
two (72) square feet ,
2) to increase the allowable area of wall signs from one
hundred (100) square feet to two hundred sixty-one
(261) square feet , and
3) to reduce the required setback for a free-standing
business sign from thirty (30) feet to one (1) foot .
After reviewing the applicant ' s plans , the staff is of the opinion
that the signage could be reduced and not adversely effect the
identification of the business. Specifically, the free-standing
sign could be reduced by sixteen (16) square feet by removing the
changeable letter part of the sign. Also, the applicant indicates
that wall signs will be mounted on the north, south and west

exposures of the building. The sign on the west exposure appears to
be unnecessary when one considers that the west side of the property
will be the location of the free-standing business sign . The wall
signage can also be reduced by eliminating the logo design from the
sign and utilizing the business name (F & M Bank) only . The plans
indicate that the area of the wall signs containing the business
name only is approximately fifty-one (51) square feet . If the
applicant were limited to two (2) of these wall signs, the aggregate
wall sign area would be approximately one hundred two (102) square
feet , creating a need for a variance of only two (2) square feet .
RECOMMENDATION
The application as presented should be denied for cause:
1) The applicant has not demonstrated that the perceived
hardship is unique to his property in contradistinction
to other properties in the same zoning district and
general vicinity. The same requirements are shared
uniformly by all properties.
2) The applicant has not provided sufficient evidence
to show that a strict application of the Zoning
Ordinance would produce a clearly demonstrable
hardship approaching confiscation as distinguished
from a special privilege or convenience. The
requirements the applicant seeks relief from is
shared by all properties zoned CO (Commercial Office) .
3) The applicant has not provided evidence that the
authorization of the variance will not be of sub-
stantial detriment to the adjacent properties or
that the character of the district will not be
altered.
